A Mumbai real estate agent, who had been in jail since December 2021 for selling property with fake documents, has been granted bail but unfortunately Suresh Pawar had died two days before the relief was granted.

The accused had been in jail since December 31, 2021 and had requested six-month temporary bail due to health concerns. Though the hearing on his bail application was completed on May 9 when he was alive, the bail order came two days after his death.

The court granted him temporary bail on humanitarian grounds, looking at his age, medical complications, and further need for medical care.

As per the bail application, he was severely diabetic and was experiencing several age-related ailments. In February, he suffered a toe injury and was taken to JJ Hospital, where he was discharged from. However, he had claimed he needed to have the toe amputated since it had turned gangrenous. His lawyer had moved the plea so that he could undergone treatment at a private hospital.

In March, the Bombay High Court gave directions to jail authorities to provide proper medical treatment, after which he withdrew his bail application from the High Court on April 19.

On the same day, Pawar’s health condition deteriorated, and he was again admitted to JJ Hospital, but due to inappropriate medical treatment, his injury became septic, and his leg below the knee necessarily required to be amputated.

Later, he developed a lung infection and sought temporary bail for a six-month period to avail himself of proper medical treatment.

The prosecution and opponent opposed his plea, arguing that he was being provided with enough medical care at JJ Hospital.

The death of Suresh Pawar will not provoke a thousand searing editorials but is scathing on the apathy and the callousness the State metes out to citizens, even if accused of crime.

The Delhi High Court on Thursday dismissed the bail plea of jailed former Aam Aadmi Party (AAP) minister Satyendar Jain in a money laundering case. The 58-year-old leader’s case is being probed by the Enforcement Directorate (ED).

The High Court rejected his bail plea, stating that the AAP leader is influential and may tamper with evidence. The court also dismissed the bail plea of two co-accused, Ankush Jain and Vaibhav Jain, stating that they have not met the twin condition of Section 45 of the PMLA.

The verdict was pronounced by Justice Dinesh Kumar Sharma who said that he didn’t find any illegality or perversity in the trial court’s order which had rejected his bail plea.

The former minister is accused of having laundered money through four companies allegedly linked to him. The court also noted that Jain and his family were either directly or indirectly controlling the companies cited in the complaint based on the shareholding patterns in those companies.

The ED arrested Satyendar Jain on May 30, 2022. After hearing the arguments from the lawyers of ED and the AAP leader, the high court postponed its decision on the bail petition on March 21.

Satyendar Jain had previously claimed that no case had been made against him, that he had participated fully in the investigation, and that there was no reason for him to remain in jail after the charge sheet was filed.

The AAP leader challenged the trial court’s November 17, 2022 order which refused his bail plea on the grounds that he was prima facie involved in hiding criminal proceeds. The trial judge further remarked that Ankush Jain and Vaibhav Jain were prima facie guilty of money laundering and had knowingly helped Satyendar Jain hide the proceeds of the crime.

The CBI registered the case in August 2017, under the Prevention of Corruption Act, and, a year later, filed a chargesheet against Jain, his wife, and four of his associates in the disproportionate assets case.

Aam Aadmi Party (AAP) leader and former Deputy Chief Minister Manish Sisodia on Friday filed a bail plea in the Delhi court in an alleged liquor scam case. The hearing of the bail will take place on Saturday, March 4 when Sisodia’s five-day custody ends.

Sisodia, who is presently on CBI remand, moved to Delhi’s Rouse Avenue Court seeking bail after the Supreme Court refused to intervene in the matter. The move comes after the apex court rejected his bail plea stating that someone cannot come here directly as the person has his/her remedies before the trial court concerned as well as the Delhi High Court.

Sisodia, who was arrested a week ago by the Central Bureau of Investigation (CBI) for his alleged involvement in the irregularities of the now-scrapped liquor policy for 2021-22, has resigned from his post.

The central probe agency arrested the AAP leader for criminal conspiracy and intent to defraud under the Indian Penal Code. He was also booked under relevant sections of the Prevention of Corruption Act after eight hours of interrogation.

The court granted five-day CBI custody to Sisodia, who was in charge of the 18 ministries in the Delhi government, for not cooperating with the investigators.

Delhi health minister Satyendar Jain who is currently serving his sentence in the city’s Tihar Jail for nine months over money laundering charges has also resigned from his position.

The resignation of his top ministers is a blow to the AAP government, which was due to go to the Lok Sabha next year. The BJP on Wednesday demanded the resignation of top opposition leader and Delhi chief minister Arvind Kejriwal, saying he occupied a constitutional post and could destroy the evidence if he continued.

A Delhi court on Thursday dismissed three bail pleas of suspended Aam Aadmi Party councilor Tahir Hussain in connection with cases related to the north-east Delhi riots that erupted in February this year. Dismissing the bail request, the court said AAP councillor act as a key player in planning, instigating and fanning the violence in north east Delhi. The court also observed that the accused was in north east Delhi at the time of eruption of communal riots. He used his muscle power in fanning riots.  

The observations in the case were made by Additional Session Judge Vinod Yadav in an order wherein he agreed with Special Public Prosecutor Manoj Choudhary’s argument that Tahir claiming parity with co-accused who is enlarged on bail was illogical. The Prosecutor also claimed that the role assigned to him in the matter is totally different from rest of the co-accused.

Tahir’s lawyer, Senior Advocate KK Manan and Uditi Bali had argued that Tahir has been caught up in a political cross-fire and the allegations against him are nothing, but a political blame game to malign his image. Tahir was falsely implicated in the matter by the investigating agency and his political rivals are harassing him.  

Additional Jude Vinod Yadav found enough on record evidences against AAP Councilor in his observation. Yadav said the applicant was very well present at the spot of crime and encouraged the rioters of a particular community for violence. He did not use his hand and fists but he was working as a human weapon in the north east Delhi riots.

According to the Delhi Police, Tahir Hussain is one of the prime accused of northeast Delhi riots in which at least 53 people lost their lives and hundreds of others were injured. Tahir Hussain was in judicial custody in the cases since March 16 this year.

Actor Rhea Chakraborty, who was sent to 14-day judicial custody on Tuesday, said in her fresh bail plea that she was coerced into making self-incriminatory confessions, which she retracted. She also said that her life was at risk in judicial custody, that she had received rape and death threats and that three investigations had taken a severe toll on her mental health and well-being.

This is her second bail petition, the first was rejected on Tuesday evening and she was sent to judicial custody. Rhea Chakraborty’s petition for bail said she has not committed any crime whatsoever and has been falsely implicated in the case. During her custody, the plea said the applicant was coerced into making self-incriminatory confessions. With her application dated September 8, she formally retracted all such incriminatory confessions, Chakraborty said.

The sessions court in Mumbai heard the bail pleas of Rhea Chakraborty and her brother Showik today. The court will pronounce orders on Rhea and Showik’s bail plea tomorrow.

Narcotics Control Bureau

The actor was arrested by the Narcotics Control Bureau (NCB) on Tuesday after a three-day interrogation for allegedly arranging drugs for deceased actor Sushant Singh Rajput. Rhea Chakraborty is currently in Byculla jail under judicial custody till September 22.

Reports said the actor had admitted to the Narcotics Control Bureau (NCB) that she had organised drugs for Rajput who died by suicide on June 14 in Mumbai. Though Chakraborty had denied ever consuming drugs earlier, she admitted she may have had them occasionally.

Sources from Byculla prison have confirmed that she has been kept in a general barrack on the ground floor where new undertrials are kept before being allotted a barrack, said an India Today report.

The NCB, in documents filed in court, said Chakraborty was an active member of a drug syndicate supplying drugs and was aware of every purchase and the amount it was sold for.

Former Congress president Rahul Gandhi and his sister Priyanka Gandhi Vadra met former finance minister P Chidambaram at the Tihar jail today. The meeting came hours before the Supreme Court began hearing his request for bail in the INX media corruption case.

His son and Congress leader Karti Chidambaram, who accompanied the Gandhi siblings for the 50-minute meeting, said, “Today Rahul Gandhi and Priyanka Gandhi Vadra met my father. This sends out a very strong message that the Congress party is with him.”

“My father has been in jail for the past 99 days. I hope he gets justice,” Karti told reporters.

The veteran Congress leader was arrested by the Central Bureau of Investigation (CBI) on August 21 in the INX Media money laundering case and was granted bail by the Supreme Court on October 22. However, he was immediately arrested by the Enforcement Directorate in the money laundering case on October 16 and has been in judicial custody till November 27.

The 74-year-old leader has challenged the Delhi High Court’s November 15 verdict, which denied him bail. The matter was listed for hearing on Tuesday before a Supreme Court bench headed by Justice R Banumathi which adjourned it for Wednesday.

On Tuesday, the ED had opposed in the Supreme Court his bail plea claiming he used the “influential office” of finance minister for “personal gains” and laundered proceeds of crime to conceal “tainted money”.

The ED also claimed that Chidambaram is a “very intelligent and influential man” and there is “sufficient evidence on record” that he has been “indulging in destruction of evidence” and “influencing the witnesses”.

Senior Congress leaders Shashi Tharoor, who also met Chidambaram on Monday, had said, “…prolonged detention of P Chidambaram is both unnecessary and speaks poorly of our system”.

“Today, the Constitution’s basic commitment to liberty is being violated. 98 days today…for what? Rs. 9.96 lakh, which is not even a controversial issue since there is a cheque involved…it sends a very bad signal…if we treat our respectable, upright citizens this way, it sends a very wrong signal to the world. We came to show our solidarity with him,” Tharoor told reporters.

Earlier, Congress president Sonia Gandhi and former Prime Minister Manmohan Singh had visited him in prison.
