The Allahabad High Court on Monday dismissed the Gyanvapi Mosque committee’s appeal challenging the Varanasi district court’s decision to offer prayers in a cellar in the Gyanvapi mosque complex. Justice Rohit Ranjan Agarwal of the Allahabad high court pronounced the judgement.

He said after going through the entire records of the case and after considering arguments of the parties concerned, the court did not find any ground to interfere in the judgement passed by the District judge dated 17.01.2024 appointing DM, Varanasi as receiver of the property as well as the order dated 31.01.2024 by which the district high court had permitted puja in the Tehkhana.

Advocate Prabhash hailed the verdict and said it is a big victory of Sanatana Dharma. The judge dismissed the pleas that the Muslim side had filed against the District judge’s order. He said this means that the puja will continue as it is. The District magistrate will continue as the receiver of the Tehkhana and the Muslim side can go for a review of the decision.

Another Advocate Vishnu Shankar Jain who is representing the Hindu side said today the Allahabad High Court has dismissed the first appeal from orders of Anjuman Intezamia which was directed against the order of 17th and 31st January and the effect of the order is that the ongoing puja in the Vyas Tehkhana of Gyanvapi complex will continue. He said if the Anjuman Intezamia comes to the Supreme Court, then they will file their caveat before the top court.

The Varanasi court on January 31 had ruled that the Hindu side can offer prayers in the southern cellar of Gyanvapi masjid – the Vyas Tehkhana. The court had also directed the District magistrate to make arrangements for prayers and a priest which is nominated by Shri Kashi Vishwanath Temple Trust.

The Varanasi court on Wednesday ruled that a priest can perform midnight puja and Aarti before the idols in a cellar of the Gyanwapi masjid, religious ceremonies were performed on the Gyanwapi premises at midnight.

According to reports the puja ceremony and rituals had begun soon after the court’s order. The aarti was performed under heavy security. Supreme Court lawyer Vishnu Shankar Jain confirmed the development. He took to X(formerly Twitter) and wrote the SG has complied with the orders of the court.

Shyan arti was carried out by a priest of KVM Trust after putting up idols. An Akhand Jyoti started in front of them. Daily arti of all above deities- morning Mangla Arti, Bhog Arti, evening arti, late sunset evening arti and Shayani arti were carried out.

A path towards the Tehkhane, where the grand Nandi is seated right in front of the Vishvanath Temple, was opened at nearly 12.00 am on thursday. The idols that were found at the Gyanwapi premises survey were placed and puja was carried out, which was followed by the offerings of the Prasad.

Authorities at the Gyanvapi complex would undertake all rituals of worship, including Shayani Aarti and Mangal Aarti, along with recitation of prayers. The offerings from the puja were handed over to the Kashi Vishwanath Trust by the administration.

The Uttar Pradesh Police has been on high alert and have been patrolling the area to avoid any untoward incidents. They were also asked to monitor social media so that rumours are not circulated. Videos circulating on social media showed security personnel deployed around the Gyanvapi complex in Varanasi.

After the Varanasi court’s ruling, advocate Sohan Lal Arya told the media that arrangements have been made but Vyas ka Tehkhana has not opened for the devotees yet. The devotees chanted Har Har Mahadev.

The court-ordered videography survey of the Gyanvapi Masjid complex, which had been ongoing for the third day, came to an end on Monday amid tight security. The survey of the mosque complex began around 8:00 am and ended at about 10:15 am.

Supreme Court on Tuesday will hear a petition challenging the survey of Varanasi’s Gynavapi Mosque. The plea filed by the Anjuman Masjid Committee against the Varanasi Court’s order requiring the survey of the Gyanvapi mosque will be heard by a bench chaired by Justice DY Chandrachud tomorrow.

While conducting a survey, lawyer Vishnu Jain claimed a big victory for the Hindu side as the shivling was found on the premises of the mosque. He said the shivling was found inside the well which was used for the wuzu.

Wuzu is a type of ritual purification in the Islamic religion for cleansing parts of the body. The 4 Fardh acts of Wudu consist of washing the face, and arms, then wiping the head and the feet with water.

After the survey was completed, the Varanasi court ordered the District Magistrate, Kaushal Raj Sharma, to seal the area where the shivling had been found. The court stated in its order that the Shivling discovery is crucial evidence and has ordered the CRPF commandant to secure the premises and prevent Muslims from entering.

According to sources, there is no order to stop the namaz in the mosque, and the district administration is reviewing the order.

Advocate Hari Shankar Jain requested that the premises be secured after a Shivling was found inside. Another Hindu lawyer, Madan Mohan Yadav, stated that the Shivling is 12 feet by 8 inches in diameter and is facing the same direction that Nandi is.

Gyanvapi Mosque Row

The Gyanvapi Mosque, which is located next to the Kashi Vishwanath Temple in Varanasi, is currently facing a legal battle.  A Varanasi court has ordered the Archaeological Survey of India (ASI) to investigate the structure of the Gyanvapi Masjid.

On April 18, 2021, five Delhi-based women, Rakhi Singh, Laxmi Devi, Sita Sahu, and others filed a petition with the court, requesting permission to perform daily prayers before Hindu deity idols on the court’s outer walls. They also attempted to prevent the opponents from causing any harm to the idols.

The Varanasi court on Thursday pronounced the judgement on the Gyanvapi mosque filming case and said that the filming should be completed before May 17. Now, the order by the district court on filming at the Gyanvapi mosque has been challenged in the Supreme Court. The matter is yet to be listed.

Notably, the filming of the Gyanvapi mosque will begin tomorrow. The district court on Thursday finalised the date for a report on the survey to be submitted as of May 17, the court-appointed two additional advocate commissioners to oversee the inspection and decided not to replace the present advocate general, as was being demanded by the mosque authorities.

It was also mentioned in the order that no person shall convert any place of worship of any religious denomination or any section thereof into a place of worship of a different section of the same religious denomination or of a different religious denomination or any section thereof.

Meanwhile, the top court on Friday declined to immediately stop the survey of Gyanvapi Mosque in Varanasi, saying the matter would have to be considered in due course.

Seeking an urgent intervention from Chief Justice of India (CJI) NV Ramana, senior advocate Huzefa Ahmadi pleaded for a status quo in the case pending before the Varanasi civil court, which on Thursday directed a day-to-day survey of a mosque to inspect, conduct videography and collect evidence regarding the alleged existence of Hindu deities inside the mosque located next to the Kashi Vishwanath Temple.

All India Majlis-E-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi recently talked about the recent Gyanvapi Masjid case verdict that came out on Thursday and said that this is a blatant violation and he hopes that the All India Muslim Personal Law Board and the Masjid committee would go to the Supreme Court.

He further said that he lost one Babri Masjid and he doesn’t want to lose another masjid.

Owaisi also said that Yogi Adityanath led government should immediately file an FIR against these people as the 1991 Act clearly says that any person who tries to change the nature of religious places that stood on 15 August 1947. And, if the court finds them guilty, they can be imprisoned for three years.

He concluded by saying this order of the court is a blatant violation of the Places of Worship Act 1991. It is a violation of the Supreme Court judgment given in the Babri Masjid title dispute.

On Thursday, the district court gave the order in the Gyanvapi survey case and said that they will not remove Court commissioner Ajay Mishra and added that the video inspection of the Gyanvapi mosque will continue should be completed by Tuesday that is May 17.

The court further demanded that the report should be submitted on May 17. Meanwhile, following the court-appointed commissioner’s survey in Gyanvapi Masjid in Varanasi, Anjuman Intezamia Masjid Committee on Saturday filed an application seeking the removal of the office due to the alleged biasedness over the matter.

In other news, a helicopter crashed at an airport in Chhattisgarh’s Raipur on Thursday. In the crash, two pilots died. The incident took place on Thursday evening. Police reported that the pilots who died were identified as Captain Gopal Krishna Panda and Captain AP Shrivastava.
