The family of Hathras gangrape victim has finally breathed a sigh of relief following a chargesheet by the Central Bureau of Investigation against the four accused. Speaking to a news channel following the development, the victim’s sister-in-law said her dying declaration had not gone in vain. In her dying declaration, the 19-year-old Dalit victim had said she was raped. Her declaration was made the prime basis of the 2000-page chargesheet filed by the central investigation agency.

Her elder brother said that it was difficult for the family to find happiness as nothing will bring their girl back, but they were satisfied with the fact that the case was coming to a justified conclusion. Her sister-in-law further expressed her disappointment with the way Uttar Pradesh police had handled the matter. She said the family kept on saying that the modesty of the girl was outraged, but they only belittled us. Referring to last rites of the victim conducted in a hurry, she said in their customs, the busy of an unmarried girl is not cremated, it’s buried. She added that no family looking for justice should be made to bear such torture.

Earlier on Friday, the Central Bureau of Investigation confirmed that the Hathras victim was gangraped and murdered in the month of September. The central agency booked the four accused Sandeep, Ravi, Ramu and Luv Kush under Sections 302 (Murder), SC-ST Act (3,2,5), 376 (Rape), 376D (Gangrape), 354 (Assault on women to outrage the modesty of women) of the Indian Penal Code.

The 19-year-old Dalit woman was gang-raped by four men of upper-caste community in Hathras on September 14. She succumbed to her injuries later at a hospital in Delhi. The case grabbed widespread attention in the country due to its handling by the Uttar Pradesh police.  The family had alleged that the victim cremated without their approval at midnight.

A doctor at Aligarh Muslim University’s Jawaharlal Nehru Medical College who had spoken to media and questioned Uttar Pradesh police’s version of the Hathras rape case has been told by the hospital that his services are not required any longer. Dr Azeem Malik had said that the FSL (forensic science laboratory) report, which stated no sperms were found in the sample, held no value as the sample was collected after a delay of 11 days.

His statement contradicted Additional Director General (Law and Order), Prashant Kumar’s statement, who had said that absence of the semen in the sample indicated that no rape took place. Apart from Dr Malik, another doctor at the hospital Dr Obaid Haque has also been issued a similar latter by the hospital. The latter had attested medico-legal case report of the 19-year-old victim.

Both the doctors received letter with CMO in-charge Dr SAH Zaidi’s signature on it stating that their appointment on the post of Medical Officer, Emergency & Trauma, JNMCH, was being rejected with immediate effect after instructions by the  Vice Chancellor of the University. The doctors were asked not to perform any further duties.  

While the doctors say that they have been suspended, the administration maintains that doctors were asked to fill in temporary vacancies created by the absence of CMOs as many of them got infected with COVID-19. It said that services of the doctors are not required any longer as CMOs have reported back to work. The administration said that they are aware that the doctors are not happy with the decision and the matter is being look into.

The Dalit woman who was gangraped by 4 men was admitted to AMU Hospital for two weeks. She was later taken to Delhi’s Safdarjung Hospital where she succumbed to her injuries. Central Bureau of investigation is currently probing the case.

The Uttar Pradesh government on Wednesday urged the Supreme Court to monitor the investigation being conducted by the Central Bureau of Investigation into the gang-rape and murder case of a 19-year-old Dalit girl in Uttar Pradesh’s Hathras. The government ensured the court that it was committed to providing security to the victim’s family and the witnesses.  

The state government has also requested the apex court to ask the central investigation agency to submit fortnightly status reports so that it can file the same in SC through its police chief. The Yogi Adityanath-led government also filed an affidavit in the top court containing the list of police personnel deployed for the security of the victim’s family. According to the affidavit, eight CCTV cameras have been installed outside the victim’s house and efforts have been made to ensure that no one intrudes the privacy of the family. The matter will be taken up by the top court for hearing tomorrow.

Meanwhile, the CBI has begun its probe into the case. The premier agency visited the crime scene on Tuesday. The CBI officials were accompanied by a forensic expert, victim’s brother and police personnel on their visit to the crime scene, which lasted around 2 hours. The CBI team formed for the case is being led by Deputy Superintendent of Police, Seema Pahuja, who had earlier investigated the Shimla rape-murder case.

The Hathras case has taken the entire country by storm with opposition parties slamming the UP police and the government over its handling of the case. Earlier on Monday, Allahabad High Court had questioned the administration of Hathras over the mid-night cremation of the woman.

The 19-year-old was brutally molested by four upper-case men in her village on September 14. She succumbed to her injuries at Delhi’s Safdarjung hospital two weeks later.

The family of the 19-year-old Hathras victim recorded their statements before the Lucknow bench of Allahabad high Court on Monday. According to victim’s family lawyer Seema Kushwaha, all three prayers of family were considered by the HC. First, the family wanted the case to be moved out of Uttar Pradesh. Second, it did not want the media to reveal the probe details as its narrative might hamper the investigation. Lastly, family should be provided security till the conclusion of the trial. Kushwaha said that an affidavit in this regard would be filed before the court on November 2.

While examining the conduct of Hathras police in the case, the court questioned the midnight cremation of the victim. The court asked if the girl would have been given the same treatment had she belonged to a rich family. District Magistrate Praveen Kumar, who was present in the court, took responsibility of the cremation. The administration said that the cremation was done at night in view of the law and order situation. The police added that the last rites of the victim were performed with family’s permission, but could not answer tough questions put forward by the court during cross-examination.

The 19-year-old girl was gang-raped by a group of four upper-caste men in her village when she had gone out to collect fodder. Her body was found by family in a deeply injury state later. The victim succumbed to her injuries two weeks later at Delhi’s Safdarjung Hospital. Yogi Adityanath-led Uttar Pradesh government is facing severe criticism due to its handling of the case. The family has alleged that the police has been threatening and intimidating them. The police have arrested four men in connection with the case. However, they have pleaded not guilty and have said that the victim was beaten up by her own family.

The Central Bureau of Investigation (CBI) will probe the gang-rape and murder of a 19-year-old woman by a group of four upper-caste men in Uttar Pradesh’s Hathras. The central agency is set to dispatch its probe teams and forensic experts to the crime scene immediately after the registration of an FIR, according to officials.

Amid nationwide outrage over the case, Uttar Pradesh Chief Minister Yogi Adityanath had recommended a CBI inquiry into the case. UP police and government have been on the receiving hand of severe criticism by opposition over its handling of the case. The victim’s family had said that the police locked them up in their home and cremated the body in their absence. However, the police denied the charges and said cremation was done only after family’s approval in a bid to avoid further tension. It further said that the family was present at the time of last rites of the victim.

The 19-year-old Dalit woman was assaulted by four upper-caste men in her village on September 14. She was referred to Delhi’s Safdarjung Hospital in an extremely critical condition where she succumbed to her injuries on September 29, two weeks after the incident . The four accused have been booked on charges of murder and gang-rape  under the SC/ST Act. The accused have said that they are not guilty and that the victim was beaten up by her mother and brother on September 14.

Following the incident, The Uttar Pradesh police had accused the family of lying and claimed that there was no rape as no sperms were found in her forensic report. The experts differed with police and said that the absence of sperms did not mean that there was no rape. The sample was collected after a delay of 11 days and the sperms would not be there in the sample by that time.

Taking strong objection to United Nation’s Resident Coordinator Renata Lok-Dessallien’s comments on Hathras and Balrampur cases, the Ministry of External Affairs (MEA) termed them as ‘unwarranted’ and ‘unnecessary’.  The ministry added that since the investigation is still underway, such remarks should be avoided.

MEA, in a statement said that the UN Resident Coordinator should be aware that these case have been taken extremely seriously by the government. It further said that the Indian constitution grants equal rights to all citizens and the country has a time-tested record of providing justice to all sections of the society.

Earlier on Sunday, UN resident coordinator in India, Renata Lok-Dessallien had expressed her sadness at the continuing cases of sexual violence against girls and  women  in India. Referring to the alleged rape and murder cases in Balrampur and Hathras, she had said that women and girls from disadvantaged social groups face additional vulnerabilities and are at greater risk of gender-based violence. She added that steps taken by Indian government to strengthen safety measures for women were welcome and urgent. The senior UN official said that the organisation was committed to support the Indian government to address the issue of violence against women in the country.

The Hathras incident  has spiralled into a full-blown controversy with Uttar Pradesh police and government facing severe criticism over their  handling of the case. The state police has asked Central Bureau of Investigation (CBI) to probe the case. UP police have said that there is an ‘international conspiracy’ to defame the state government and stir up caste-based tensions and  have filed at least 19 complaints in connection to it.

The 19-year-old woman was allegedly brutally molested by  four upper-caste men in her village on September 14. The woman died at a hospital in Delhi on September 29 sparking nationwide outrage.

In a major development in the Hathras case, Uttar Pradesh chief minister Yogi Adityanath recommended Central Bureau of Investigation probe into the matter on Saturday evening. The UP Chief Minister’s office tweeted that the UP CM Yogi Adityanath has ordered the CBI probe into the entire Hathras case.

The order to hand over the case to the CBI came on a day when former Congress president Rahul Gandhi, UP Congress Priyanka Gandhi Vadra met the family of the victim in the village 200 km from Delhi. The Opposition parties have been demanding the CM’s resignation in the case, where a 19-year-old Dalit girl was gangraped and then grievously injured which led to her death two weeks later.

Rahul Gandhi after meeting with victim’s family in Hathras told ANI that no power in the world can suppress the family’s voice.

Priyanka Gandhi after meeting the family told ANI that the family wants security, a judicial inquiry into the incident and removal of the district magistrate. Hitting out at the UP government she said that the family couldn’t see their daughter for the one last time and Yogi Adityanath should understand his responsibility. Till the time justice was delivered, the congress would continue this fight.

On the other hand, furious protests against the police and the government have been staged across the country. In the national capital on Friday, Delhi Chief Minister Arvind Kejriwal made an appearance and demanded that the four accused be executed.

At least two more assaults and rapes have been reported from UP since the Hathras case. The ruling BJP had dismissed protests by the opposition as a political stunt. However, Yogi Adityanath lad government came under pressure after furious protests against UP’s law and order situation and cremation of victim’s dead body in night including its treatment of the young woman’s traumatised family.

The body of the 19-year-old Dalit woman, who died two weeks after being gang-raped by four upper caste men in Uttar Pradesh’s Hathras district, was allegedly forcibly cremated by the Uttar Pradesh Police in the early hours of September 30 in the village of Boolgarhi, against the wishes of her family.

She succumbed to her injuries at Delhi’s Safdarjung Hospital yesterday. The victim’s family said at 2:30 am while they were at their home, the police cremated the body without their permission.

When the victim’s body reached her village in Hathras in an ambulance, her family stated that the police had forcibly taken her body and performed the last rites. They said that they had requested police that they wanted the last rites to be performed according to the Hindu traditions but they didn’t listen to them. The police claimed the cremation was done in the presence of the victim’s family after the body reached the Boolgarhi village in Hathras district. Hathras Superintendent of Police (SP) Vikrant Vir denied any urgency by police in cremation.

The victim was raped in Uttar Pradesh’s Hathras village by four men on September 14 and died a fortnight later after battling serious injuries. The woman was first taken to Jawaharlal Nehru Medical College and Hospital in Aligarh, but shifted to Safdarjung Hospital in Delhi after her condition deteriorated.

On Wednesday, Uttar Pradesh Chief Minister Yogi Adityanath tweeted that those responsible for the gang-rape and murder of a 19-year-old Dalit woman shall not be spared. He said Prime Minister Narendra Modi had spoken to him and asked him to ensure the accused got the strictest punishment.

Congress general secretary Priyanka Gandhi tweeted that the Dalit girl had been a victim of demoniac behaviour in Hathras. For two weeks, she kept struggling between life and death in hospitals, said Priyanka. She added that incidents of rape in Hathras, Shahjahanpur, and Gorakhpur districts had shaken the state.

Delhi Chief Minister Arvind Kejriwal demanded that the guilty should be hanged as soon as possible. He also added that the death of the Hathras victim is shameful for the society, the country as well as for all the governments. It is sad that so many daughters are being sexually assaulted and we have not been able to protect them, Kejriwal tweeted in Hindi.
