The Juvenile Justice Board in Hyderabad on Friday ruled that four of the five accused minors in the Jubilee Hills gang-rape case of a teenage girl can be tried as adults. Whereas the fifth accused, the son of an AIMIM legislator, might be tried as a juvenile.

The principal magistrate, G Radhika, Juvenile Justice Board cited that she had gathered after talking to the 5 accused CCL, children in conflict with the law, that to her understanding, the accused have a mental and physical understanding of the consequences of the crime.

She further added that the CCLs were not under the influence of drugs or alcohol, which implies that the accused were not in control of their minds to determine right from wrong. Hence, with an understanding of the heaviness of the crime, Radhika believes that the 5 accused should be tried as adults for their crimes.

The Principal Magistrate, while hearing out the case, also disagreed with the aspect of the 5 accused being tempted to commit the crime by the welcoming of the victim or the aspect of the children not having legal education which resulted in them not realizing the consequences of the crime.

A teenage girl, who agreed to be dropped home by the accused after attending a party, was raped in the car by four people in Hyderad’s Jubilee Hill in June. After the incident, the father of the victim reported the case to the Hyderabad police on 2nd June. A case was registered against 5 CCLs (Children in conflict with the law) and one adult who is also the prime accused, under the charges of rape, whereas, the son of the MP was charged with molestation charges.

Subsequently after, the Hyderabad police arrested five minors and an 18-year-old, Saduddin Malik. The Hyderabad police, in order to get the suspects maximum punishment, appealed for the CCLs to be tried as adults. The Juvenile Justice Board and Psychologists have since then evaluated the situation and have ruled that 4 out of the 5 CCLs can be tried as adults.

The involvement of AIMIM’s legislator’s son has sensationalised the case as the opposition parties have been launching AIMIM party for giving tickets to such leaders.
