HC raps Delhi Police on Kanhaiya flip-flop

The slow judicial procedure in the country does not only hamper the country’s development but also diminishes people’s confidence in the whole governance system.  There are several reasons for the slow-paced judicial system, but sometimes judicial officers and High Court judges also express their frustration on “irresponsible police behavior” and “delaying” of the entire process.

The country witnessed the tough stand taken by Delhi High Court on August 10, when Justice PS Teji pulled up Delhi Police for “changing” stand on JNU Students Union President Kanhaiya Kumar’s bail cancellation. The court said that police was “playing with the court proceedings”.

The Delhi High Court was commenting on the changing of stand by Delhi Police. In the earlier “affidavit”, Delhi Police alleged Kumar of “violating” the “letter and spirit” of the bail granted to him by making public speeches.  However, the fresh affidavit filed last week by the same authorities claimed that Kumar “seemed to have violated” the conditions of his bail, but added that it was “up to the court to form appropriate opinion in the light of material placed on record”.

Reacting to the matter, Justice Teji said that “police have made a mockery of the system” and added “I don’t want you (police) to play hide and seek with the court.”  The court did not stop here and said “The reply you filed is very funny… it states that the court will decide the bail cancellation issue”. The angry judge also noted that police had not taken a clear stand on the issue “from the last three dates”.

Responding to the court’s tough stand, senior standing counsel for Delhi government Rahul Mehra was forced to clarify: “We (Delhi Police) are not seeking cancellation of Kanhaiya’s bail.”

Such is the careless attitude being witnessed in the national capital where media, civil society and judicial activists are supposedly thriving. This is not the first time when the issue was raised by a High Court judge. It is only the tip of the proverbial iceberg. There are thousands of cases in the lower and sessions courts which have been facing delays because of the irresponsible behavior of the government agencies. Constant research of various court orders proves that thousands of cases remain pending due to absence of public prosecutors and investigating officers during the court hearings.

This incident is, in fact, just another reflection of the fact that the Delhi Police is not independent but a pawn of the union government. The center itself has changed its stand several times vis-à-vis the JNU students. The behavior of the police, which controlled by the MHA, has kept pace with the government’s.
