Trinamool Congress MPs Mausam Noor and Jawahar Sircar along with three Congress MPs have filed a privilege motion against Ranjan Gogoi, former CJI of the Supreme Court. Gogoi landed into trouble after giving an interview to NDTV in which he commented that he goes to the Rajya Sabha whenever he feels like it.

Gogoi, in the interview, said he goes to the Rajya Sabha when he feels so and when there are matters that he deems important. He added that he is not governed by any party and is a nominated member.

When asked about his time in the Rajya Sabha, Gogoi expressed discontent with the pay. He compared himself to a tribunal chairman. 10 other parliamentarians from different parties are presumed to file similar motions.

The former CJI said that entering the Rajya Sabha before the last Winter Session without an RT-PCR. Gogoi also said that he did not feel comfortable going to the sessions. Parliament records also suggest that the former CJI has attended less than 10% of meetings. Gogoi was nominated to Rajya Sabha 4 months after his retirement from the Supreme Court.

When one or more of the rights and immunities are violated, a breach of privilege occurs, and it is punishable under Parliamentary law. A notice in the form of a motion can be filed by any member of either House against persons who have been found guilty of a breach of privilege.
