In a recent update in the Rajiv Gandhi assassination case, Supreme Court on Wednesday ordered the release of A G Perarivalan, who is one of the life convicts in the assassination case. It is reported that Perarivalan alias Arivu was 19-years-old when he was arrested on June 11, 1991. He was accused of having bought two 9-volt Golden power battery cells for Sivarasan, the LTTE man who masterminded the conspiracy. At that time, the batteries were used in the bomb that killed Rajiv Gandhi on May 21 that year.

A bench comprising Justices L Nageswara Rao and BR Gavai made an observation that the Tamil Nadu Cabinet took the decision to grant remission to Perarivalan on relevant considerations. The bench also said that inordinate delay by the Tamil Nadu governor in exercising his powers under Article 161 of the Constitution can be subject to judicial review.

In May 1999, Perarivalan was sentenced to death after being held guilty and in 2014, his sentence and of two others were commuted to life.

Earlier, the bench passed the aforesaid order in a plea filed by A.G. Perarivalan, the life convict in the Rajiv Gandhi assassination case, seeking release from the prison based on the recommendation made by the State Government in September 2018. The Bench reserved the judgement on May 11, 2022, and made it clear that in the present order it would limit itself to the issue of the reference of the decision of the Council of Ministers of Tamil Nadu made by the Governor to the President.
