Mudda discusses SC judgment, says death being politicised<\/em><\/p>\n

The Supreme Court bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud ordered that there was no merit in the Judge Loya case and dismissed the case. The bench was hearing the plea seeking independent probe into the mysterious death of Justice BH Loya<\/a> who was handling the Sohrabuddin Sheikh case.<\/p>\n

The bench said that the death was a natural death and that there will be no probe. It said: \u201cWe can\u2019t doubt the statements of the judicial officers who were with Loya in his last hours.\u201d<\/p>\n

Thursday\u2019s edition of Mudda, APN<\/em>\u2019s daily current affairs show, discussed the issue. Moderated by Anant Tyagi, the guests were petitioner in the case Bandhuraj Lone, former chairman of UP Law Commission Justice AN Mittal, Supreme Court<\/a> advocate Vinay Vats, BJP spokesperson Anand Sahu, Congress spokesperson Surendra Rajput, legal journalist Rakesh Kumar Singh and APN<\/em> consulting editor Govind Pant Raju.<\/p>\n

Rakesh Kumar Singh said the issue had become a political issue rather than just being about the judge\u2019s death. Surendra Rajput, too, agreed. He said: \u201cWe respect the Supreme Court and its decision. Our legal team is reading the whole judgment. As far as the issue of Rahul Gandhi meeting the President goes, we have that right to do so\u2026 There are still some unanswered questions. Why was the judge changed? Why was Amit Shah not present at the hearings of his case? We demand that the death be investigated and we get our answers too.\u201d<\/p>\n

Justice AN Mittal said it is unfortunate how some petitioners waste the time of the court because of some vested interests. He said: \u201cSome people have made public interest litigations a business. They want to come to the limelight. They are often sponsored by a political party or influenced by an agenda. All they do is waste the apex court\u2019s time.\u201d<\/p>\n

Vinay Vats pointed out that petitioners are trying to scandalise the court by bringing up the issue four years later. He said: \u201cIf they question the integrity of the judges who shall we go for justice?\u201d Bandhuraj Lone said that no protocol was followed. He said: \u201cLoya was taken to a hospital where there was no ECG machine available. Also, his body was sent to Latur without his family\u2019s permission. The post mortem report too contains contrary statements which need to be investigated.\u201d<\/p>\n

Vats cleared the doubts. He said: \u201cThe protocol is in case of emergency one is taken to the nearest hospital. When he was taken to the nearest hospital the ECG machine was not available there. So while he was being transferred to another hospital, he died on the way. Nowhere in the law is it stated that one needs the permission of the family members for post mortem.\u201d<\/p>\n

Anand Sahu said that no one should politicise the issue and alleged that the Congress of such misdoings. Govind Pant Raju said: \u201cIt can be clearly seen that the issue is being politcised. Some people are doing it for mass appeal and political propaganda. You are pointing the finger at the whole system and creating an air of suspicion unnecessarily.\u201d<\/p>\n
