According to a notice, Nepal’s Supreme Court on Wednesday issued a temporary directive to the administration to temporarily register same-sex unions.<\/p>\n\n\n\n
The government was given the green signal to make the required preparations for registering the marriage of sexual and gender minority couples upon demand by a single bench of Justice Til Prasad Shrestha.<\/p>\n\n\n\n
A writ to the Prime Minister and the Office of the Council of Ministers was sent by seven people, including campaigner Pinky Gurung on behalf of the LGBTI rights organisation Blue Diamond Society (BDS), asking them to legalise same-sex marriage.<\/p>\n\n\n\n
The top court’s judgment also directs the opponents to provide a written response on the matter within 15 days.<\/p>\n\n\n\n
The petitioners said, te filled the writ because, despite the Supreme Court’s decision that permitted same-sex marriages 15 years ago, Nepalese law continues to forbid such marriages.<\/p>\n\n\n\n
The petitioners have asked for the legalisation of same-sex marriage, citing Clause 69 (1) of the National Civil Code 2017 which states that every citizen has the freedom to marry, and Clause 18 (1) of the Nepalese Constitution 2015 which states that all citizens are equal in the eyes of the law.<\/p>\n\n\n\n
While addressing the media after the court’s judgement, Pinky Gurung of BDS said, same-sex marriages can now be recognised by law until and unless appropriate legislation is created to recognise couples who identify as sexual and gender minorities.<\/p>\n\n\n\n
Despite the fact that the Supreme Court had approved same-sex marriage through an order fifteen years prior, the provision could not be put into effect due to the lack of a particular law, which compelled third-gender people to file a lawsuit.<\/p>\n\n\n\n
However, in India, where the Supreme Court has deferred its decision on the legalisation of same-sex unions following a hearing that lasted ten days, the question of same-sex marriage is also an important matter. Those who support legalising marriage contend that doing so will grant them benefits and rights that they would not otherwise be able to enjoy.<\/p>\n\n\n\n
The Delhi Commission for Protection of Child Rights (DCPCR) has additionally pushed for the country to legalise same-sex unions.
