The Supreme Court today, January 16, halted the Allahabad High Court’s order permitting a court-monitored inspection of Shahi Idgah, which is next to the Krishna Janmabhoomi shrine in Mathura.<\/p>\n\n\n\n
In instances pertaining to the disagreement over the relocation of Shahi Masjid Idgah in Mathura, the court did permit the continuation of proceedings before the Allahabad High Court.<\/p>\n\n\n\n
The Hindu organisation Bhagwan ShriKrishna Virajman and others were asked to respond to a plea by the mosque committee against the High Court’s order regarding the survey of Shahi Idgah. The bench of Justices Sanjiv Khanna and Dipankar Datta made this request.<\/p>\n\n\n\n
The bench questioned the vague application submitted to the high court seeking the appointment of a court commissioner for the survey, stating that various legal concerns have emerged.<\/p>\n\n\n\n
A vague application cannot be submitted for the position of court commissioner. The goal should be made quite clear. You cannot rely solely on the court to investigate matters, the bench informed senior lawyer Shyam Divan, who was representing Hindu organisations such as Bhagwan ShriKrishna Virajman and others.<\/p>\n\n\n\n
The bench made it clear that the high court’s procedures regarding the issue will go on while announcing that it is sending notice to the Hindu bodies and requesting their answer.<\/p>\n\n\n\n
Earlier, on December 15, of last year, the Supreme Court had refused to issue a stay of the Allahabad High Court’s ruling, allowing the Shahi Idgah survey to proceed under court supervision.<\/p>\n\n\n\n
The court informed the Muslim side that, rather than requesting a stay through an oral plea, they should contest the order through a legal appeal.<\/p>\n\n\n\n
