Trinamool Congress leader Mahua Moitra is scheduled to appear before the Delhi High Court today to oppose a notice demanding her to vacate the government bungalow she was given as an MP, according to sources.<\/p>\n\n\n\n

The leader of the Trinamool Party, who was removed from office as a Lok Sabha MP last month due to unethical behaviour, will soon file a writ suit in the court of Justice Manmohan challenging the eviction notice.<\/p>\n\n\n\n

According to Moitra’s lawyers, she is a candidate\u00a0for the Lok Sabha elections. From the final day of the Parliament session preceding a general election until the day of results, MPs are permitted to remain in their apartments, they have said. They have contended that since Moitra has been listed as a candidate, this should also apply to her, Moitra’s lawyer claimed.<\/p>\n\n\n\n

Earlier, the Centre had requested to Moitra to vacate the bungalow immediately in a strongly-worded eviction notice. The Directorate of Estates, which oversees government assets, sent out a notice stating that Ms. Moitra and any other occupants are liable to be evicted from the said premises, if need be, by the use of such force as may be necessary if she did not leave on her own.<\/p>\n\n\n\n

Moitra was allowed sufficient opportunity, according to the government’s notice, but she was unable to provide evidence that she is not an unauthorised occupant.<\/p>\n\n\n\n

Moitra had also petitioned the High Court prior to this. She was then instructed by the court to seek the Directorate of Estates for permission to temporarily occupy the bungalow. The court had observed that in certain extraordinary cases, regulations allowed authorities to grant a resident a six-month overstay in exchange for payment of specific fees.<\/p>\n\n\n\n

However, the court let Moitra to withdraw her petition without commenting on the case’s merits.<\/p>\n\n\n\n

According to the eviction order, Moitra will have to pay damages for each month if she chooses to contest the eviction notice in court.<\/p>\n\n\n\n

Moitra lives in a home on Telegraph Lane in Delhi. On January 7, one month after her removal from the House of Commons, her government accommodation assignment was revoked. Prior to this year’s Lok Sabha elections, Ms. Moitra had requested more time.
