The Uttarakhand Assembly on Wednesday, passed the Uniform Civil Code Bill, introduced by the Chief Minister Pushkar Singh Dhami-led government. With this, Uttarakhand has become the first state in India to pass such a law.<\/p>\n\n\n\n
Even after the Opposition\u2019s demand to refer the Bill to the select committee of the House, the Uttarakhand Assembly passed the UCC Bill. The Bill which will now become an act after the President\u2019s assent, will replace the old personal law that governs marriage, divorce, succession and live-in relationships.<\/p>\n\n\n\n
The Bill was tabled before the Assembly today two days after the Uttarakhand Cabinet approved the final draft of the Bill.<\/p>\n\n\n\n
In 2022, a committee was formed by the Dhami-led government to prepare the draft of the UCC Bill. The committee comprised of a five-member panel headed by the retired judge of the Supreme Court Ranjana Prakash Desai. <\/p>\n\n\n\n
The former Chief Justice of Sikkim High Court Permod Kohli, social activist Manu Gaur, retired IAS officer Shatrughan Singh, and Doon University Vice-Chancellor Surekha Dangwal were the other members of the committee. <\/p>\n\n\n\n
The implementation of the UCC Bill comes ahead of the 2024 Lok Sabha elections. According to reports, the Centre may bring a similar law at the national level. The reports further suggest that BJP-ruled states like Assam and Gujarat are already planning to bring UCC in their respective states.<\/p>\n\n\n\n
Amongst several BJP\u2019s agenda, the UCC was one of the foundational items. From the abrogation of Article 370 in Jammu and Kashmir and the construction of Ram Mandir in Ayodhya.<\/p>\n\n\n\n
With this Bill, there will be a common law for marriage, divorce, and inheritance of property among others. Earlier, it was governed by personal laws of every religion. The UCC bars the bigamy and polygamy.<\/p>\n\n\n\n
The members belonging to the Scheduled Tribes (ST), will be out of the purview of the law, the state government clarified. The UCC will not apply to members of any Scheduled Tribes within the meaning of clause (25) of Article 366 read with Article 142 of the Constitution of India and the persons and group of persons whose customary rights are protected under Part XXI of the Constitution of India, the statement read.<\/p>\n\n\n\n

The members of Scheduled Tribes, as per clause (25) of Article 366 and Article 142 of the Indian Constitution, are exempt from the application of the UCC.
