The All India Majlis-E-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi today moved the Supreme Court seeking to stay the implementation of the Citizenship Amendment Act (CAA), 2019 and the Rules, 2024.

Owaisi, in his petition to SC, said that no applications seeking a grant of citizenship status would be entertained or processed by the government under Section 6B of the Citizenship Act,1955, as it stands amended by the Citizenship (Amendment) Act, 2019, during the pendency of the proceedings.

Notably, Owaisi had filed a petition before the apex court in 2019 as well, stating that the present CAA miserably fails on the touchstone of Article 14 of the Constitution.

The Ministry of Home Affairs on March 11 notified the CCA rules for the implementation of the Citizenship (Amendment) Act 2019, almost five years after it was passed.

Union Home Minister Amit Shah on March 11 said that the Modi government had notified the Citizenship (Amendment) Rules, 2024. These rules will now enable minorities persecuted on religious grounds in Pakistan, Bangladesh and Afghanistan to acquire citizenship in our nation. With this notification PM Modi has delivered on another commitment and realised the promise of the makers of the constitution to the Hindus, Sikhs, Buddhists, Jains, Parsis and Christians living in those countries, he said in a post on X.

The Act, which fast-tracks the process of getting Indian citizenship for migrants belonging to Hindus, Sikhs, Buddhists, Jains, Parsis and Christians and excludes the rest including Muslims who fled from persecution in Pakistan, Afghanistan, and Bangladesh and entered Indian territory before December 31, 2014, was passed in 2019.

After the central government notified the rules by filing interlocutory stay applications in their pending writ petitions, several petitioners moved to the Top Court.

On March 14, the Ministry of Home Affairs launched an online portal after announcing the implementation of CAA just weeks ahead of the Lok Sabha elections. While speaking with ANI, Shah asserted that the Citizenship Amendment Act will never be taken back and the central government will never compromise with it.
