The plea was heard by Justice Prathiba M Singh who noted DGCA's submission and posted the matter for further hearing on March 23.
Shankar Mishra is accused of urinating on a co-passenger on board a New York-Delhi Air India flight on November 26.
In addition to that, the DGCA also imposed a fine of Rs 3 lakh on Air India's director-in-flight services.
Delhi Police had registered an FIR against Mishra on January 4 on a complaint filed by the woman to Air India.
Reports also said the court denied sending Mishra into police custody.
