Congress says UCC cannot become political instrument to keep country in permanent polarisation

The Congress said on Thursday that the establishment of a uniform civil code (UCC) should occur only after extensive discussions aimed at creating genuine consensus and should not serve as a political tool to maintain a state of “permanent polarisation” in the country.

This declaration follows the recent implementation of the UCC by the BJP-led Uttarakhand government and the formation of a committee by the Gujarat government, headed by a retired Supreme Court judge, to evaluate the necessity of a UCC in that state and to draft a bill.

Congress general secretary for communications, Jairam Ramesh, criticized the Uttarakhand UCC, labelling it as poorly constructed and overly intrusive. He remarked that it fails to act as an instrument of legal reform, as it does not address the long-standing concerns regarding family law. Instead, Ramesh claimed it has been imposed as part of the BJP’s divisive strategy.

Ramesh highlighted that, in light of the Gujarat government’s announcement of a committee to draft a UCC, this move follows the recent enforcement of the UCC in Uttarakhand, which notably exempts scheduled tribes.

He referenced a 182-page ‘Consultation Paper on Reform of Family Law’ submitted by the 21st Law Commission under the Modi Government in 2018. In it, Para 1.15 notes that while the diversity of Indian culture should be embraced, it is essential to ensure that specific groups, particularly weaker sections of society, are not disadvantaged in the process. The paper calls for addressing discriminatory laws rather than advocating for a UCC, suggesting that the mere existence of cultural differences does not equate to discrimination.

He further argued that the framers of Article 44 of the Constitution could not have predicted the introduction of multiple uniform civil codes through state legislatures in a fragmented manner. Ramesh emphasized that a true UCC, as outlined in Article 44, requires in-depth debate and consensus-building and should not be used as a political device to intensify societal divisions.

Recently, the BJP-led Gujarat government established a committee headed by former Supreme Court judge Ranjana Desai to assess the UCC’s necessity and draft corresponding legislation, with a report expected in 45 days. Uttarakhand has already become the first state in India to implement the UCC, which aims to standardize personal laws regarding marriage, divorce, and property for all citizens, regardless of religion.

According to statements shared by both leaders after the meeting, discussions focused on enhancing collaboration to combat terrorism, curb narcotics trafficking, strengthen border management and improve efforts to bring criminals to justice in both countries.

Shah said the two sides had a detailed discussion on expanding India-US cooperation in the security domain, particularly in counter-terrorism and counter-narcotics initiatives. He also reiterated India’s commitment to advancing the India-US Comprehensive Global Strategic Partnership under the leadership of Prime Minister Modi.

Meeting follows high-level engagement at G7 summit

The interaction took place shortly after the Modi-Trump bilateral meeting during the G7 Summit in France, where the leaders discussed trade, regional security, economic cooperation and other strategic issues. They also reviewed progress in various areas of bilateral cooperation.

Following his return from France, Gor described the Modi-Trump engagement as productive and highlighted positive outcomes for India-US relations. He said the two leaders held substantive discussions on trade, regional security and strengthening economic ties.

The latest meeting between Shah and Gor underscores continued high-level engagement between New Delhi and Washington on security and strategic matters as both countries seek to deepen cooperation across multiple sectors.

The result comes as another example of cross-voting influencing Rajya Sabha elections, a trend that has been discussed in several states during recent Upper House contests.

Congress candidate misses out

While JMM’s Baidyanath Ram and BJP-backed Parimal Nathwani emerged victorious, Congress nominee Pranav Jha failed to secure one of the two available seats. The outcome is likely to trigger political debate over voting patterns within the state assembly and the extent of cross-voting during the election.
