Rahul Gandhi to contest conviction in defamation case tomorrow in Surat’s Session Court

Congress leader Rahul Gandhi’s legal team will be moving to appeal the conviction of the Congress leader in a 2019 defamation case in Surat’s Session Court tomorrow. As per the reports, Rahul Gandhi will also appear before the court in the hearing.

The plea by the Congress leader has sought the Sessions Court to overturn the conviction order ruled by the Magistrate in the Defamation case. The plea also seeks an interim stay on the conviction till the matter is concluded.

The plea comes after Rahul Gandhi was granted bail and given a 30-day limit to appeal the decision. The Congress leader was convicted in a defamation case for his remark on Modi’s surname in 2019. The magistrate convicted the Congress leader annd gave him a 2 year prison term on March 23.

Following Rahul Gandhi’s conviction, he was also disqualified as an MP from Lok Sabha ascribing to the rules of the Parliament.
If the Congress leader’s conviction is not put on hold, the Election Commission is likely to schedule by-polls for Wayanad’s seat.

As per the rules, Rahul Gandhi will also be barred from contesting elections for the next eight years if the Sessions Court doesn’t set aside the conviction order of Rahul Gandhi.

The Congress leader’s disqualification notification by the Lok Sabha was met with scathing criticism from across party lines against the Government. Various leaders commented and highlighted the instant speed the former Congress MP was disqualified.

Following the disqualification of Rahul Gandhi, the Congress leader was also instructed to vacate his Delhi residence as he was not entitled to it.

The disqualification also led to Opposition Parties teaming up and accusing the Centre of ‘dictatorial’ rule. The disqualification also led to the Congress workers across the country taking out protests on the street.

However, the BJP has responded to the criticism by citing that the move was lawful and also questioned the Congress leader if he believes that he is above the law. The BJP has also slammed the disqualified Congress leader for insulting the OBC community and sought an apology from him.

During the ongoing special session, the government reiterated its commitment to ensuring fair representation while addressing concerns raised by opposition parties regarding the timing and structure of the legislation.

The proposed framework aims to reserve 33 percent of seats for women in the Lok Sabha and state assemblies. However, its implementation is tied to a fresh delimitation exercise, which is expected after the next census.

Opposition questions timing and intent

Opposition leaders have raised concerns that linking the women’s quota to delimitation could delay its implementation. They argue that the process of redrawing constituencies may push the actual rollout further into the future.

The issue has triggered a broader political confrontation, with multiple parties questioning whether the move could alter representation across states.

Some critics have also alleged that the delimitation exercise could disproportionately benefit certain regions based on population, a charge the government has rejected.

According to sources, the security personnel deployed by Punjab Police have been asked to report back, marking a significant development in the political dispute involving the Rajya Sabha MP.

The move comes shortly after Chadha was removed from his position as deputy leader of the party in the Rajya Sabha, signalling deepening differences between him and the party leadership.

Centre offers fresh security arrangement

Soon after the withdrawal, the Ministry of Home Affairs stepped in to provide security cover to Chadha.

Sources indicate that he will now receive Z-category security in Delhi and Punjab, while a Y-category cover may be provided in other parts of the country.

This shift ensures continued protection for the MP despite the withdrawal of state-provided security.
