Supreme Court stays former IAS trainee officer Puja Khedkar’s arrest in UPSC cheating case

On Wednesday, the Supreme Court granted protection from arrest until February 14 to former IAS probationer Puja Khedkar, who had been accused of cheating and improperly claiming OBC and disability quota benefits in the civil services examination.

A bench comprising Justices B. V. Nagarathna and Satish Chandra Sharma issued notices to the Delhi government and the Union Public Service Commission (UPSC) regarding Khedkar’s request for anticipatory bail. The bench directed, “Issue notice returnable on February 14, 2025. Until the next hearing date, no coercive actions shall be taken against the petitioner.”

During the proceedings, senior advocate Siddharth Luthra, representing Khedkar, contended that the High Court had made strong remarks against her when it dismissed her bail plea. The Supreme Court remarked that Khedkar had not yet faced any punitive actions, stating, “No one had touched her.”

Luthra argued that should the case proceed to trial, it would likely result in a conviction due to the substantial findings made by the High Court. When the Supreme Court inquired about Khedkar’s current situation, Luthra revealed that she had lost her job and was seeking legal recourse.

The court scheduled the next hearing for February 14, 2025. Khedkar is accused of providing false information in her application for the 2022 UPSC civil services examination to benefit from reservation quotas. She has denied all allegations against her.

In dismissing her anticipatory bail request, the High Court established a strong prima facie case against Khedkar and stated that further investigation was necessary to uncover a “larger conspiracy” involving attempts to manipulate the examination system. The court noted that granting bail could be detrimental to this investigation.

“Anticipatory bail plea is dismissed. Interim protection from arrest is vacated,” the High Court concluded. Khedkar had previously been granted interim protection when the court issued notice regarding her bail application on August 12, 2024, which had subsequently been extended.

The High Court emphasized that the UPSC examination is a prestigious evaluation, and this case exemplified fraud against a constitutional entity and the public. The anticipatory bail plea faced opposition from Delhi Police counsel and the complainant, the UPSC. Khedkar’s legal team argued for her cooperation with the investigation, noting that all evidence was documentary in nature, thus indicating that her custody was not necessary. However, the Delhi Police insisted on her custodial interrogation to uncover the potential involvement of others in the case.

The UPSC opposed Khedkar’s bail plea, claiming she had committed fraud against it and the public, asserting that her interrogation was essential to revealing the “magnitude” of the fraud, which they believed required the assistance of others. The commission has initiated various actions against Khedkar, including filing a criminal complaint for allegedly utilizing fraudulent means in the civil services examination, leading to the Delhi Police filing an FIR for several offences.

Trouble is brewing for BJP’s Parvesh Verma after the Delhi Police filed a case against him on Wednesday regarding the distribution of shoes to voters. The Returning Officer for the New Delhi Assembly Constituency alerted the Station House Officer (SHO) Mandir Marg Police Station about this issue on January 15.

The controversy arose from the BJP candidate’s distribution of shoes at Valmiki Temple, just days before the assembly polls scheduled for February 5 in the national capital. The Returning Officer requested the SHO to register a First Information Report (FIR) and initiate an immediate investigation following a complaint against Parvesh Sahib Singh Verma.

A video shared by the Aam Aadmi Party (AAP) on X showed Verma, the son of former Delhi Chief Minister Sahib Singh Verma and a two-term MP from West Delhi, placing shoes on elderly women’s feet and then seeking their blessings while his supporters chanted “Long live Parvesh Verma.”

In its post featuring the video, filmed at the Valmiki Temple near Mandir Marg in the New Delhi constituency, AAP stated, “Can’t the Election Commission see democracy being undermined? On one hand, BJP candidate Parvesh Verma is openly distributing shoes on the streets while posing for photos and videos. On the other hand, the District Election Officer remains silent. If the Election Commission does not take action against this blatant violation of the code of conduct, what does it mean for elections and the democratic process?”

Following a complaint filed by a lawyer, the Returning Officer for the New Delhi constituency sent a letter to Mandir Marg police station on Wednesday requesting the registration of an FIR against the BJP leader.

The Returning Officer noted, “According to Section 123 of the Representation of the People Act, 1951, any gift, offer, or promise made by a candidate or their agent, or by any other person with the candidate’s or their election agent’s consent, constitutes corrupt practices.”

He added, “Consequently, I direct that an immediate investigation be conducted into this matter, appropriate action be taken for the violation of the Model Code of Conduct (MCC), and that a report on the actions taken be submitted to me at the earliest.” In response to the Returning Officer’s letter, an FIR has now been registered against Verma.

The written examination for the JK Police Constable position was held on December 1, 8, and 22, 2024, at designated centers across Jammu and Kashmir to facilitate smooth participation for all candidates.

Conducted offline in an OMR-based format, the exam consisted of 100 multiple-choice questions designed to assess candidates’ general knowledge, aptitude, and job-specific skills required for the Constable role. Each correct answer was awarded 1 mark, while incorrect answers were penalized with a deduction of 0.25 marks due to negative marking. Candidates had a total of 2 hours to complete the examination, which was conducted in English.
