Karnataka: Governor’s deadline for trust vote was for CM, no voting till debate over – Speaker

The turmoil in Karnataka politics does not seem to be any nearer to a resolution today (Friday, July 19) as questions of powers of Governor and that of Speaker came up on the issue of the wobbly Congress-JD(S) coalition government’s trust vote motion to decide the issue.

The Governor, whose first deadline for completing trust vote by 1:30 pm today passed unheeded, remained unfazed and issued a new deadline of 6 pm today. There was little likelihood of it being respected, though.

Meanwhile, Karnataka Pradesh Congress Committee (KPCC) President Dinesh Gundu Rao has moved the Supreme Court claiming that the apex court’s order dated July 17 (which directed that 15 rebel MLAs cannot be compelled to attend Assembly) violated the party’s right under the Tenth Schedule of the Constitution to issue whip to the legislators.

Earlier, Speaker Ramesh Kumar contended that the Governor’s order to complete the floor test by 1.30 pm was for HD Kumaraswamy to decide since the letter was sent to the Chief Minister. Governor Vajubhai Vala had stepped in yesterday after the Speaker remained undecided on the resignations of the rebel MLAs and directed Chief Minister HD Kumaraswamy to prove his majority by 1.30 p.m. on the floor of the Assembly on Friday.

The confidence motion was initiated in Assembly today with a list of legislators scheduled to speak and it was clear that the Governor’s deadline ignored completely. When the Assembly took a break till 3pm, speaking to journalists Congress leader Siddaramaiah ruled out the possibility of a floor test today. “The discussion is still not complete and 20 members are yet to participate. I don’t think it will finish today and will continue on Monday,” he was quoted as saying by ANI.

“Speaker is supreme on this matter,” he said.

While BJP members pressed for vote immediately, Speaker KR Ramesh Kumar told them that they cannot press for division of vote till the debate is concluded. Assembly rules stipulate a motion can be put to vote only after the debate is concluded. “I will not violate the rules of the house,” says the Speaker.  

“Whether the Governor’s order has to be followed or not will be decided by the Chief Minister because the letter was sent to him. It’s left to him to obey it or not. I will conduct the house as per the rules of the house,” he said.

Earlier, he had made it clear: “Unless the discussion is over, there cannot be a vote.”

While BJP members continued to protest over the issue, the deadline of 1.30 pm given by the Governor for a vote had passed. The Congress and the JD(S) members took exception to Governor Vajubhai R. Vala’s message to Speaker KR Ramesh Kumar and to the House to set a time limit to complete the process on trust motion moved by Chief Minister HD Kumaraswamy. They raised slogans “Go Back Governor” and called him BJP and Amit Shah’s agent. This led to a pandemonium in the House.

Speaking at the Assembly session which began at 11 am, Kumaraswamy told the Speaker that he has to decide whether the Governor can set a deadline for him (1.30 pm Friday) to prove majority. He also referred to a Supreme Court verdict that the Governor cannot act as ombudsman of Legislature.

“The Governor has set a deadline for me at 1:30 pm to prove my majority. Supreme court has left to your discretion to conduct the proceedings of the house. I have already moved the motion of confidence. I will leave it to your discretion to decide whether the governor can issue such direction,” Kumaraswamy told the Speaker. 

“There needs to be a debate about how constitutional provisions are being circumvented. Can it be completed in such short time?” he asks.

Minister Krishna Byre Gowda argues that Governor can stipulate time for the Chief Minister to seek confidence motion when he feels he has lost majority. “But this case is different. Here the Chief Minister has already moved the motion and is under debate. The motion is the property of the house. Our constitution doesn’t let anyone to become dictatorial either governor or the speaker,” he says.  He cited judgements of the Supreme Court to bolster the argument that Governor cannot intervene in this matter and set deadlines.

BJP MLA J C Madhuswamy says the session and government were different. “It is he who has installed this government and he has the right to ask such govt to prove its majority at any moment”, he says. He said the party is not interested in any further debates citing precedents. Byre Gowda shots back saying “it’s not surprising from a party that does not believe in Constitution”. 

Senior Minister RV Deshpande says Governor had a constitutional right to seek a confidence motion, but that was before the motion was moved. Once the motion has been moved, it’s left to the speaker to decide on the proceedings. “We have to follow good precedents and values of democracy,” he said.

Senior BJP leader Basavaraj Bommai argues that the Governor has a right to interfere when the govt is already in minority. Congress objects to this and asks from where he is drawing such an inference. Leader of opposition BS Yeddyurappa demands division of vote.

Speaker KR Ramesh, on the other hand, lashed out at the legislators for accusing him of delaying the trust vote process and indulging in “character assassination”. “You may have your own apprehensions but let me make it clear… I have led fairly in public life. Character assassination is easy but those commenting on me please look at your background,” he said.

Karnataka: 6 boys held for riding two-wheelers with Palestinian flag

Six minors were apprehended after a video of them allegedly riding two-wheelers holding the Palestinian flag surfaced on social media platforms, Karnataka Police said on Monday.

According to police, the incident took place on Sunday around 1 pm on Dantaramakki road in Chikkamagaluru town in Karnataka.

The official said that three of the 6 boys were on a two-wheeler and one of the pillion rider, a 17-year-old boy was allegedly holding and waving a Palestinian flag while three of their friends followed them on another bike.

They also shouted slogans on ‘free Palestine’, according to police.

A senior police officer said that police apprehended all the six boys involved in the incident. They are all minors, he added.

The police have registered a case under appropriate sections of Bharatiya Nyaya Sanhita, including sections for disturbing communal harmony, a police officer said. Adding that both the vehicles have been seized along with the flag, according to news agency PTI.

The police found during the interrogation that the boys had watched some videos of a procession in Uttar Pradesh in which people were seen carrying Palestinian flags and so they wanted to make a similar reel on Instagram.

Speaking on the matter earlier today, former BJP national General Secretary and MLC CT Ravi alleged that without permission a rally was held yesterday in more than 20 two-wheelers and one four-wheeler holding a Palestine flag.

Ravi said: “I have got information that some influential people had tried to influence in favour of the people involved, more than 200 people came in front of the police station, so an explanation was sought and they were let go. I urged the police for a detailed probe and to destroy the network behind them, the incident should not be taken lightly.”

Former Karnataka CM Yediyurappa booked under POCSO for assaulting 17-year-old

Former Karnataka Chief Minister and senior BJP leader BS Yediyurappa has been booked under the POCSO (Protection of Children from Sexual Offences) Act, and 354 (A) IPC for assaulting a 17-year-old girl.

According to the FIR, the victim was sexually harassed on February 2 when she and her mother visited him seeking help in another alleged sexual assault case. Reportedly, the 81-year-old BJP leader sexually assaulted the victim after dragging her into a room. When the victim ran out of the room, she complained to her mother about the assault, as per the reports.

The mother of the minor girl filed a complaint with the Sadashivanagar Police in Bengaluru.

Meanwhile, Yediyurappa has rejected the allegation and questioned the timing of the complaint, coming just weeks ahead of the Lok Sabha election.

Addressing the media, the senior BJP leader said he helped the complainant financially. The timing is questionable since the FIR comes just ahead of the polls, he said.

He also claimed that the minor girl visited him seeking help with some cases of cheating. However, the girl didn’t speak to him properly which gave him the idea that she may not be mentally sound, the former CM said.

A few days ago a woman came to his house. She was crying saying that there was some problem. Yediyurappa asked her what was the matter and he personally called the police commissioner about the matter and told him to help her, the former Karnataka CM said while speaking to reporters. Later, the woman started talking against him. He brought this matter to the attention of the police commissioner, he added. However, police filed a complaint against him on Thursday.

Karnataka Home Minister G Parameshwara said a lady registered a complaint against Yediyurappa last night. Police have registered the case. Until they know the truth, they can’t reveal anything, he asserted. This is a sensitive thing as it involves a former CM and he added he doesn’t think there is any political angle to this. If the distressed woman needs protection, then it will be given, he further added.

Karnataka Chief Minister Siddaramaiah inaugurates Indira canteen at Bangalore International airport

Chief Minister Siddaramaiah on Monday unveiled an Indira Canteen at Bengaluru’s Kempegowda International Airport and said that 600 Indira Canteens would be set up across Karnataka, including in the national capital. The Bruhat Bengaluru Mahanagar Palike, which runs the canteen, expects around 2000 customers, mostly airport cab drivers and bus drivers of the Bengaluru Metropolitan Transport Corporation.

The canteen, along with the kitchen has been constructed at a cost of Rs 1.35 crore. A BBMP official said that the passengers were also expected to have food at the canteen. He added many passengers are going to depend on Indira Canteen for their food.

After unveiling the canteen Siddaramaiah said they are starting 188 new Indira Canteens in Bengaluru taking the total count in the state to 600. He said 2 canteens have been started as per demand as per demand of taxi drivers and other drivers. He said 40 canteens have already been completed and the rest are underway. The Karnataka Chief Minister said the purpose of the Indira Canteen is to provide meals and breakfast to the poor at low rates.

He said breakfast will be provided at Rs 5 and lunch and dinner will be available at Rs 10. The chief minister said the food menu has been changed and a dining hall has been arranged. He said Indira Canteens will be set up in every ward of Bengaluru and also in other parts of the state.

Setting up Indira canteens was one of the 36 demands submitted by the federation of cab and autorickshaw drivers associations to Transport Minister Ramalinga Reddy. The demand came in view of driver’s stressful commute between the airport and the city and also the exorbitant rates charged by restaurants at the airport terminals.
