Judge vs Judge: Supreme Court pauses all proceedings before Calcutta HC, issues notice to West Bengal

According to reports, there have been irregularities in the issuance of reserved category certificates and admission of Medical students in state-run medical colleges and hospitals.

The Supreme Court on Saturday issued a notice to West Bengal and paused all the proceedings before the Calcutta High Court, which noticed a rare conflict between a single judge and a division bench over an investigation by the probe agency Central Bureau of Investigation (CBI) into the alleged fake caste certificate scam case.

According to reports, there have been irregularities in the issuance of reserved category certificates and admission of Medical students in state-run medical colleges and hospitals.

The apex court had taken the suo moto cognisance of the verdict passed by a single bench of the Calcutta High Court.

In its verdict, illegal and ignored have been termed by the Calcutta HC in a case of alleged irregularities in the admission of MBBS candidates in state-run medical colleges and hospitals.

Chief Justice of India, DY Chandrachud-led constitution bench of five judges will now take up the matter in a special hearing on Monday.

The conflict erupted after the Calcutta High Court’s single-judge bench and division bench passed orders against, agreeing each other.

Justice Abhijit Gangopadhyay’s order had accused Justice Soumen Sen of favouring with political party in West Bengal. Justice Gangopadhyay further accused him of deciding to save some political party in power and called Justice Sen’s actions tantamount to misconduct.

The single-judge bench ordered authorities to disregard the division bench order and instructed the CBI to commence its investigation into the matter of the fake caste certificate. Additionally, on January 24, the single bench requested the Bengal Police to provide the CBI with relevant documents.

Earlier this week, the order was stayed when it was brought up before a division bench consisting of Justice Sen and Uday Kumar. Unfortunately, this didn’t last long.

Justice Gangopadhyay, presiding over a single judge bench, once more addressed the issue and instructed the West Bengal police to provide documents to the CBI. Following a disagreement on Thursday, the division bench, the single judge reconsidered the matter and made remarks against Justice Sen.

Amid Parliament Standoff, Leader of Opposition in the Lok Sabha Rahul Gandhi met Speaker Om Birla and urged him to expunge derogatory remarks made in the House against his family and the Congress. 

After the meeting, Rahul Gandhi told the reporters that the speaker said that he would look into the matter regarding derogatory comments. He added that the Opposition’s aim is that the House must run and discussion should happen in the House. The Congress leader remarked that no matter what the BJP says about him, they want to have a debate on December 13. He continued that the BJP will keep levelling allegations on them but the House must function.

BJP Lok Sabha MPs Nishikant Dubey and Sambit Patra on December 5 had riled up the Opposition Congress by alleging links between Rahul Gandhi and Hungarian.

A day after, while speaking in the House, Nishikant Dubey brought up Soros and the global investigative news network OCCRP (Organised Crime and Corruption Reporting Project).

The BJP leader remarked that the Congress has relations with OCCRP, which gets all its funds from the US government and George Soros. He further questioned if Rahul Gandhi took money from George Soros for the Bharat Jodo Yatra?”

The BJP MP’s statement had caused a high-voltage drama as Congress MPs stormed the Well of the House in protest. Later, the House was adjourned. Following, the Congress members demanded to know the status of their notices regarding breach of privileges against Dubey and Patra.

While responding to queries about BJP’s Patra calling Rahul Gandhi a traitor, Congress MP Priyanka Gandhi Vadra said that those who can call Jawaharlal Nehru, Indira Gandhi and Rajiv Gandhi traitors, have no qualms about calling Rahul Gandhi one. 

Notably, the Winter Session of Parliament has been a washout so far after repeated disruptions on multiple issues. When the session commenced, Congress MPs demanded a discussion on the US Department of Justice indictment against the directors of Adani Green, which led to differences within the Opposition ranks because Congress allies like Trinamool Congress wanted the House to function and discuss issues such as price rise, Manipur unrest and unemployment.

In an unfortunate incident, Bengaluru techie Atul Subhash died by suicide after alleging harassment by his estranged wife in videos and social media posts. His family has filed a police complaint against his wife, her family members and a judge.

The brother of the 34-year-old techie, Bikas Kumar has reportedly filed an FIR in Bengaluru fir abetment to suicide against his wife Nikita Singhania, her mother Nisha Singhania, her brother Anurag Singhania and her uncle Sushil Sinhania.

Atul Subhash, who hails from Uttar Pradesh, lived in Bengaluru and worked for a private firm. He left a 24-page note detailing what he alleged was years of emotional distress because of harassment and multiple cases filed by his wife and her family, and a judge in Uttar Pradesh. 

Speaking to the media, Bikash Kumar said that his brother did everything for her. He expressed that whatever has happened is unfortunate, adding that if Atul Subhash had discussed the situation with him or their father, they would have helped him get out of this situation. 

He further requested the Central government and the President to give justice to his brother, if he is with truth otherwise give him the proof to show his brother is wrong. He demanded that there should be a proper investigation against the judge who is named in the suicide note.

Bikas Kumar further stated that his brother in his suicide note stated that if he win from the system, his mortal remains should be devoted in Ganga otherwise in a gutter outside the court.

The FIR stated Atul Subhash married Nikita Singhania in 2019 and they had a child together. The complaint further alleged that after their divorce, Nikita Singhania and her family filed a false case against Atul Subhash and insisted on Rs 3 crore to settle the case.

The Bengaluru police on Monday received a call at 6:00 am about a suicide in a flat. The police found the flat bolted from inside, and broke in to find Atul Subhash hanging.

The police also found the 24-page note in which Atul Subhash wrote, Justice is Due , on every single page. Beside his wife and her family, Subhash also accused a family court judge in Uttar Pradesh’s Jaunpur of not hearing him out, and an officer of the court of taking bribes in front of the judge. He claimed his wife had filed nine cases against him, including murder, sexual misconduct, harassment for money, domestic violence, and dowry.

He described the instances that he said drove him to his death. He recorded a video describing his alleged harassment and asking his family members not to immerse his ashes until he got justice. He further had a message for his four-year-old son, who he claimed had been kept away from him. The suicide note also called for his parents to be given custody of his child.

Ahead of the Delhi Assembly Election, the controversy regarding Delhi Chief Minister’s bungalow, once occupied by Arvind Kejriwal, has intensified ahead of the assembly polls in the national capital. The BJP has been referring to the 6 Flag Staff Road bungalow as sheesh mahal or palace of mirrors, which denotes opulence or luxury.

Taking to X, Delhi BJP President Virendraa Sachdeva said that they have been telling the truth about the glass palace of debauchery of the person who calls himself a common man (ArvindKejriwal). He added that today they will show it to the people. Sharing a video, the BJP Delhi President said that Kejriwal has built a 7-Star Resort for himself by embezzling public money. 

Sachdeva further pegged the cost of the bungalow at a whopping Rs 3.75 crore, equipped with a gym, sauna room and a jacuzzi. He mentioned that the bungalow had marble granite lighting done at a cost of Rs 1.9 crore while civil work needed another Rs 1.5 crore, adding that the gym and spa fitting alone cost Rs 35 lakh.

He further slammed Arvind Kejriwal for breaking his promise not to use government resources for personal use. The BJP President said that Kejriwal had promised not to take government houses, cars, or security, but now he is looting the hard-earned money of Delhi’s taxpayers.

Furthermore, he also compared the amount spent on the bungalow to the possible number of public goods that could have been bought with that money, including flats for economically weaker sections (EWS), auto-rickshaws, and e-rickshaws. 

Meanwhile, the AAP rejected the allegations as baseless propaganda with Manish Sisodia, former deputy chief minister, accusing the BJP of trying to deflect attention from the pressing issues.

The AAP leader said that instead of answering critical questions about mismanagement of funds for schools, mid-day meals, and hospitals in states like Haryana and Uttar Pradesh, they focus on Kejriwal’s former official residence. He continued that when people ask about education and health reforms, they talk about a bungalow.
