Madhya Pradesh elections: 29 candidates, including MLAs have criminal charges against them

Reportedly, 16 Congress MLAs, 12 Bharatiya Janata Party (BJP) MLAs and one Bahujan Samaj Party (BSP) MLA have charges framed against them.

Madhya Pradesh elections: 29 candidates, including MLAs have criminal charges against them

Ahead of the Madhya Pradesh Assembly election, a report from the Association for Democratic Reforms (ADR) and Madhya Pradesh Election Watch stated that twenty-nine out of the 230 (13%) members of the Madhya Pradesh Legislative Assembly have criminal cases against them that would disqualify them from serving as MLAs if they were to be convicted.

The report underlined that these cases have been pending for more than 17 years. The Association for Democratic Reforms (ADR) claims that this is a void in the law that is open to exploitation by various parties. It further stated that the Supreme Court should step in the area left purposely vacant by the lawmakers and come up with required directions by debarring the entry of such elements from electoral and political process.

Reportedly, 16 Congress MLAs, 12 Bharatiya Janata Party (BJP) MLAs and one Bahujan Samaj Party (BSP) MLA have charges framed against them. The criminal offences fall under Section 8 of the Representation of People Act, 1951 and include serious, grave and/or heinous crimes like murder, rape and robbery, as well as offences related to narcotics and drugs or corruption and money laundering. Subsections 8 (1), 8 (2) and 8(3) list the offences that would lead to the candidates being disqualified from becoming MPs or MLAs if they are convicted, convicted with a punishment of not less than 6 months, or convicted with a punishment of not less than two years, respectively.

Furthermore, the MLAs have these charges pending against them for an average of six months. Around 10 MLAs have a total of 12 cases against them pending for ten years or more.

Dilip Gurjar of the Congress, who is contesting from Nagda-Khachraud assembly seat of Madhya Pradesh, has had charges of voluntarily causing hurt by dangerous weapons or means, voluntarily causing grievous hurt, rioting, armed with deadly weapon pending against him for 17 years, the longest in the MP Assembly. Ramkhelawan Patel of the BJP, also has charges defamation pending for 16 years. In addition, Vikram Singh of the BJP, Mahesh Parmar of the INC and Narmada Prasad Prajapati of the INC have cases pending against them for 15, 13 and 12 years respectively.

Nonetheless, the report notes that there may have been a change in the status of these cases which will only be known if the MLAs decide to file nomination papers for the upcoming elections in Madhya Pradesh, which are scheduled for November 17.

BJP questions Rahul Gandhi over Parliament chaos, Congress calls it distraction

The BJP today slammed the INDIA bloc led by the opposition parties over the scuffle that took place in Parliament. Union Minister Shivraj Singh Chauhan questioned Rahul Gandhi over the chaos, and called the opposition leaders Goons. He said that the country will never forget whatever happened in Parliament today.

The Union Minister stated that Mallikarjun Kharge and Rahul Gandhi just did a press conference, adding that they thought they would apologise for what they did today. He continued that their press conference displayed their arrogance. He further claimed that what Rahul Gandhi did today is unimaginable by a civilised society.

The BJP leader further claimed that the Leader of Opposition Rahul Gandhi started pushing senior party leaders during the protest. He said that BJP MPs have complained about the incident and they will take all the required legal action.

The BJP leader also accused Rahul Gandhi of entering the Makar Dwar intentionally, adding that security personnel in fact told the Opposition to use the other space on the side to enter, but Rahul Gandhi came there on purpose.

Meanwhile, Congress President Mallikarjun Kharge and Leader of Opposition in Lok Sabha Rahul Gandhi held a press conference just minutes before the BJP and accused the saffron party of trying to erase the memories and contributions of the architect of the Indian Constitution, Dr BR Ambedkar.

The statements from both sides came after chaos unfolded outside Parliament on Thursday. Both the BJP and INDIA bloc MPs got engaged in protest, counter-protests, and now a police case has been lodged against Congress MP Rahul Gandhi. These political slugfest occurred over a remark on BR Ambedkar by Amit Shah in Parliament during a debate on the Constitution.

While addressing the media, Congress leader Rahul Gandhi accused the BJP MPs of stopping opposition leaders and said that they were peacefully going to Parliament House from Ambedkar’s statue, but the BJP MPs did not let them go inside. He mentioned that the reality is that the BJP have insulted Dr BR Ambedkar, and the main issue that they want to erase is that there is a case against Narendra Modi’s friend Adani in the United States.

Furthermore, Congress president Mallikarjun Kharge also attacked the BJP MPs for trying to stop opposition leaders at the door.

No-confidence motion against Rajya Sabha Chairman Jagdeep Dhankhar rejected, Deputy Chairman calls motion flawed

The no-trust motion moved by the Opposition against Rajya Sabha Chairman Jagdeep Dhankhar has been rejected by the deputy chairman on the grounds that it was moved to mar the reputation of the Vice President.

Deputy Chairman Harivansh in his detailed order called the motion flawed, adding that it was drawn in haste to mar the reputation of the Chairman. While explaining the reasons for the rejection, the Deputy Chairman pointed out that the mandatory 14-day notice required to move such a motion was not provided.

Furthermore, he noted that Jagdeep Dhankhar’s name was misspelled in the notice. Nonetheless, one protocol that was adhered to correctly was securing the signatures of 60 MPs when the motion was submitted last week.

In the ruling, presented in the House by Rajya Sabha Secretary General PC Mody, the Deputy Chairman stated that the impeachment notice is part of a deliberate effort to undermine the nation’s constitutional institutions and tarnish the reputation of the incumbent Vice President.

Reportedly, the motion, submitted under Article 67(B) of the Constitution, was backed by the Samajwadi Party, the Trinamool Congress and the AAP, leading to an uproar in the Upper House of Parliament.

Notably, for the first time in Rajya Sabha’s history, a motion to remove the Chairman was introduced. The INDIA bloc accused Chairman Jagdeep Dhankhar of acting in a partisan manner, a concern that intensified during the winter session of Parliament.

This winter session has been marked by frequent clashes between the Opposition and the ruling party since it commenced on November 25. While speaking in defence of the Chairman in the Rajya Sabha, Union Minister Kiren Rijiju, called him a farmer’s son who upheld the dignity of the House.

Slamming the opposition MPs, Rijiju added that they have no right to be members if they can’t respect the Chair, mentioning that MPs have taken an oath to protect the sovereignty of the country.

Amid massive Parliament chaos, BJP MP from Nagaland Phangnon Konyak filed a complaint with Rajya Sabha chairman against Congress leader Rahul Gandhi, accusing him of misbehaving with her by standing too close and causing discomfort during simultaneous protests by the BJP and Congress outside the Parliament earlier on Thursday. 

In her letter, the BJP MP narrated that he was standing just below the staircase of Makar Dwaar with a placard in his hand. She added that the security personnel had cordoned and created a passage to the entrance right for the moment of MP’s of other parties. Suddenly, Leader of Opposition, Rahul Gandhi along-with other party members came in front of her despite there being a passage created for them, she continued.

The BJP MP further claimed that Rahul Gandhi misbehaved with her in a loud voice and his physical proximity to her was so close that being a lady member she felt extremely uncomfortable.

Konyak further stated that she stepped aside with a heavy heart and denouncing her democratic rights but felt that no Member of Parliament should behave this way.

She further expressed that as a woman and member of the ST community, her dignity and self-esteem were deeply hurt by Rahul Gandhi’s actions and sought the Rajya Sabha Chairman’s protection. Additionally, she also raised the same allegations while speaking at Rajya Sabha.

Later, Rajya Sabha Chairman Jagdeep Dhankhar acknowledged receiving the complaint and stated that he is looking into the matter. Jagdeep Dhankhar said that the woman MP came to him crying, and that he has the information. He added that the BJP MP met him, and she was in a state of shock. The Rajya Sabha Chairman further asserted that he is paying attention to the matter.

Earlier on Thursday, BJP MP Pratap Chandra Sarangi alleged that he was left injured after Rahul Gandhi pushed a parliamentarian who, taking him along, fell down.
