After a month of son’s death, UP BJP MLA says still struggling to file FIR against hospital, says police not helping

A UP BJP legislators, who lost his son due to a private hospital’s negligence during Covid second wave, had been struggling for over a month to register an FIR against the hospital even after written to the UP chief minister Yogi Adityanath and Union health minister Harsh Vardhan.

Rajkumar Agarwal, BJP MLA from Sandila in Hardoi district, Uttar Pradesh, had been trying for a month to register an FIR against a hospital for alleged negligence in his son’s death but the police are not filing an FIR. Speaking with ANI, he told that his son Ashish (35) died on April 26 at a hospital in Kakori where he was admitted after testing positive for Coronavirus.

Agarwal alleged that his 30-year-old son, who was admitted to a hospital in Kakori town in Lucknow district on April 22, died four days later due to hospital’s negligence.

While speaking with reporters, the BJP MLA said the oxygen level of his son was 94 on April 26 morning and was having regular conversations with the family. Later in the evening, doctors told that his oxygen level was decreasing.

The MLA said he had arranged an oxygen cylinder from outside for his son but the doctors did not accept the cylinder arranged from outside. However, in the absence of oxygen, his son died. Aggarwal alleged that his son died due to negligence of the hospital administration and doctors. The MLA said he is trying to file an FIR to get justice for his son.

Speaking with the reporters, Agarwal said seven people died in the day when his son died in hospital. He had also written the matter to UP CM Yogi Adityanath, District Magistrate, Police Commissioner and Director-General of Police but still his complaint was not registered.

He also demanded that police should analyse the CCTV footage of the hospital and see who is responsible for the death of his son. He also urged the government that accused doctors responsible in his son’s death, should be punished.

Uttar Pradesh is one of the worst affected states by the Covid second wave which crossed death toll over 20,000 on Friday with 159 more people succumbing to the disease. A total of 2,402 new Covid cases were also reported in the state. There were 52,244 Active Covid cases in Uttar Pradesh till Friday.

Assam Chief Minister Himanta Biswa Sarma resigned from his post on Wednesday, paving the way for the formation of a new government after the BJP-led NDA secured a decisive victory in the 2026 Assembly elections.

Sarma submitted his resignation to Governor Lakshman Prasad Acharya at Lok Bhawan in Guwahati. The Governor accepted the resignation and asked him to continue as the caretaker Chief Minister until the new government takes charge.

The resignation comes after the NDA’s strong electoral performance, where the alliance won a clear majority in the 126-member Assembly, ensuring its return to power for another term.

Oath ceremony expected after May 11

Speaking to reporters after submitting his resignation, Sarma said the swearing-in ceremony for the new government is likely to be held after May 11.

He indicated that Prime Minister Narendra Modi has been invited to attend the ceremony but is unavailable until May 11, which has influenced the tentative schedule.

Decision on next chief minister soon

Sources suggest that central observers, including senior BJP leaders, are expected to arrive shortly to oversee the selection of the legislature party leader. The newly elected MLAs will then decide on the next Chief Minister.

Despite the formal resignation, party sources indicate that Sarma is likely to continue in the role for another term, given the BJP’s strong mandate in the state.

The move marks the beginning of the government formation process in Assam following the election results declared earlier this week.
