A special Terrorism and Disruptive Activities (prevention) Act court today convicted gangster Abu Salem and 5 others accused in the 1993 Mumbai serial bomb blasts which left 257 people dead and 713 injured apart from destroying properties worth crores. The accused included Musthafa Dossa, Abu Salem, Feroz Abdul Rashid Khan, Taher Merchant, Riyas Siddiqui, Abdul Qayyum Sheikh and Karimullah Khan. Abdul Qayyum Sheikh was acquitted by the court and will be released soon.

Six among seven accused, who were arrested between 2003 and 2010, were convicted under charges including criminal conspiracy, waging war against the nation and murder under sections of Indian Penal Code, under the now repealed TADA Act, and under relevant sections of the Indian Explosives Act and Explosive Substances Act.

Abu Salem was accused of going to Gujarat in order to collect arms. The accusation against Taher Merchant was that his house in Dubai was used for training those who participated in the attack. Accused Riyas Siddiqui was convicted for aiding and abetment of a terrorist act under section 3(3) of TADA Act. He has been acquitted from all other charges as the court said that the prosecution failed to prove the charges of conspiracy against him.

Since these seven people were arrested at the end of the trial of the first set of accused in the case, the court decided their trial to be separate.

According to the CBI, the serial blasts were planned and executed to ‘strike terror in people’ in retaliation to the Babri Masjid demolition in Ayodhya, Uttar Pradesh. The conspiracy to take revenge for the Masjid demolition is said to be done under the leadership of Dawood Ibrahim and Ibrahim Mushtaq Abdul Razak Memon (Tiger Memon), who are still on the run.

Mumbai serial blasts are the first ever terrorist attack in the world in which RDX (Research Department Explosive i.e. cyclotrimethylenetrinitramine) was used on a large scale after the World War II, according to CBI.

The court has set the next hearing date on June 19 on which the date for the argument for quantum of sentence will be decided.[/vc_column_text][/vc_column][/vc_row]

Delhi Court extends judicial custody of CM Arvind Kejriwal till May 20 in Liquor policy case

The top Court said that interim bail will only be granted if the AAP supremo agrees to refrain from discharging any official duties

A Delhi court on Tuesday extended the judicial custody of CM Arvind Kejriwal till May 20 in the Liquor policy case. Kejriwal was produced before the court via video conferencing on the expiry of his custody which was granted earlier. Special Judge for CBI and Enforcement Directorate Kaveri Baweja also extended the judicial custody of co-accused Chanpreet Singh till May 20.

The order coincided with the hearing in the Supreme Court as Arvind Kejriwal had challenged his arrest by the Enforcement Directorate in the liquor policy case. The two-judge bench of Justices Dipankar Datta and Sanjiv Khanna expressed that it will consider the question of interim bail for Arvind Kejriwal. The court said that Arvind Kejriwal is the elected chief minister of Delhi and the current circumstances are extraordinary as the Lok Sabha elections are taking place.

Solicitor General Tushar Mehta who was appearing for the Enforcement Directorate, objected to the Supreme Court hearing arguments on interim bail and asked what example are we setting? He asked if the other people are less important than the chief minister.  He further questioned why a chief minister is being treated differently than a common man. Mehta added there cannot be any deviation only because he is a chief minister.

During the hearing, the top court told Arvind Kejriwal’s counsel that granting interim bail to the chief minister would come under the condition that he will refrain from carrying out any official duties, as this can potentially cause conflicts. The court said that had there been no elections, it would not have given any interim relief and added that they do not want to interfere with the working of the government.

The Enforcement Directorate arrested Arvind Kejriwal on March 21 in connection with corruption allegations linked to Delhi’s liquor policy, charges which have been denied by the Aam Aadmi Party. He is currently under judicial custody in Tihar jail.
