Counting Day: Election Commission says no entry without Covid test report, 2 vaccine shots

The Election Commission on Wednesday said candidates will not be permitted inside vote counting centres on May 2 without a negative Covid report or two vaccine doses. The poll body has made RT-PCR tests, that are not more than 48 hours old, mandatory for candidates on the election result day.

The Election Commission on Wednesday said candidates will not be permitted inside vote counting centres on May 2 without a negative Covid report or two vaccine doses. The poll body has made RT-PCR tests, that are not more than 48 hours old, mandatory for candidates on the election result day. 

The results of legislative assembly elections held in Assam, West Bengal, Tamil Nadu, Kerala, and Puducherry is scheduled to be announced on May 2 (Sunday). While the eighth and last phase of ongoing West Bengal poll is due on April 29, the voting has completed in other three states and one Union Territory.

According to the new ECI’s Covid-19 guidelines, any public gathering outside the counting centres on Sunday shall be banned. The candidates and their agents will be needed to provide a list of counting agents three days before counting day.

The sitting arrangements of the counting agents will be made in such a way that between the  two counting agents, one shall be in PPE. Every person should follow thermal screening, and should wear face masks, carry hand sanitisers, the new order said.

The new announcement comes amidst the spiralling Covid-19 cases in the country. Earlier, the poll body had banned any victory celebrations during and after the voting results. It also said that not more than two persons shall be allowed to accompany the winning candidate or his/her authorised representative to receive the certificate of election from the returning officer concerned.

The elections were held in the states with the crowded campaigns and roadshows by leading parties and politicians drew flak as Covid safety rules like masks and distancing were completely ignored. It was only last week that the poll body had enforced restrictions on the campaign and limited the crowd size to 500, after Prime Minister Narendra Modi cancelled his visit to Bengal for a series of rallies citing a Covid meeting.

Kerala woman Greeshma sentenced to death for poisoning her boyfriend to end their relationship.

In a chilling case of a relationship gone horribly wrong, a local court in Kerala has sentenced a 24-year-old woman, Greeshma, to death for poisoning her boyfriend in an attempt to sever ties with him. The sentence, delivered on Monday, comes nearly two years after the gruesome crime took place in 2022.

The court found Greeshma guilty of murdering her then 23-year-old boyfriend, Sharon Raj, by lacing an ayurvedic tonic with paraquat, a deadly herbicide. The victim succumbed to the poison after an agonizing 11-day battle in which he suffered multiple organ failures. The motive behind the crime was Greeshma’s desire to end the relationship after Raj reportedly refused to accept her decision to marry someone else.

Greeshma’s uncle, Nirmalakumaran Nair, was also convicted for his role in the case. He was found guilty of destruction of evidence, although Greeshma’s mother was acquitted due to insufficient evidence.

The case was built on circumstantial, digital, and scientific evidence, including the toxicology report that confirmed the presence of paraquat in Raj’s body. Despite her defense, which included pleas citing her age, academic achievements, and lack of a criminal history, the court did not show leniency, deeming the crime as falling under the “rarest of the rare” category for which capital punishment is warranted.

The prosecution argued that Greeshma had previously attempted to kill Raj by mixing paracetamol tablets into his fruit juice. However, the plan failed when Raj refused to drink the bitter concoction. When that attempt did not succeed, she resorted to the deadly tonic, which led to his tragic demise.

Raj, a native of Parassala in Thiruvananthapuram district, was a BSc Radiology student at the time of his death. His family has expressed their relief following the verdict, while the victim’s lawyer, Special Public Prosecutor VS Vineeth Kumar, emphasized the importance of the death sentence, describing it as an exemplary judgment.

The court’s ruling sends a strong message about the severity of crimes involving premeditated murder, especially when it involves the use of poison and the betrayal of trust in a relationship.

Supreme Court grants interim relief to Rahul Gandhi in defamation case over remarks against Amit Shah

In a significant legal development, the Supreme Court of India has granted interim relief to Congress leader Rahul Gandhi by staying the defamation proceedings against him in a Jharkhand court. The case, which dates back to 2018, revolves around allegedly derogatory remarks made by Gandhi about Union Minister Amit Shah, who was then serving as the president of the Bharatiya Janata Party (BJP).

A bench comprising Justices Vikram Nath and Sandeep Mehta passed the order while hearing a petition filed by Gandhi seeking to quash the defamation case. The court has issued notices to both the Jharkhand government and Naveen Jha, a BJP worker who had filed the complaint, directing them to submit their responses within four weeks.

In his arguments, Senior Advocate Dr. Abhishek Manu Singhvi, representing Rahul Gandhi, pointed out previous rulings where it was made clear that only the aggrieved party can file a criminal defamation complaint. Singhvi argued that the complaint, in this case, had been filed by a proxy third party and thus should not be entertained.

The defamation case against Gandhi had been under trial in the MP/MLA court in Chaibasa, Jharkhand. In February of the previous year, the lower court had issued a non-bailable warrant for his appearance after he failed to attend hearings. Despite Gandhi’s request for exemption from physical appearance, the court had refused to provide relief, prompting him to approach the Jharkhand High Court. However, the high court had declined to interfere in the matter, leaving Gandhi with no option but to challenge the case in the Supreme Court.

The top court’s intervention has now provided a temporary reprieve to Gandhi, with the matter scheduled to be taken up for further hearing in six weeks. This development marks an important chapter in the ongoing legal battle involving the Congress leader and the BJP.

As the case progresses, the outcome could have significant implications not only for Rahul Gandhi but also for the broader political landscape in the country, as defamation lawsuits continue to be a contentious issue in Indian politics.
