Non-functional panels, including human rights commission in Jammu and Kashmir under consideration: Centre tells Supreme Court

The issue of statutory panels, including the human rights commission—which are allegedly non-functional in Jammu and Kashmir—is under consideration, the Central Government informed the Supreme Court on Friday, while asking the apex court for three weeks to apprise it of developments.

A Public Interest Litigation (PIL) filed by Pune-based Advocate Asim Suhas Sarode in November last year, had claimed that various statutory panels were not functional—including the State Information Commission, the human rights body, and the consumer panel—in the Union Territory after the abrogation of Article 370 in the erstwhile state, and sought the solicitor general’s assistance to deal with the issues raised.

A Supreme Court bench comprising of Chief Justice DY Chandrachud, and Justices PS Narasimha and JB Pardiwala took note of Solicitor General Tushar Mehta’s submissions that the issue raised in the PIL is being considered at an “appropriate level” while also directing the petitioner to also make the union territories of Jammu and Kashmir, and Ladakh parties to the PIL.

The CJI ruled the matter for listing after three weeks, while also directing the Centre to apprise the bench about developments in the matter on the next date of hearing.

The apex court had taken note of Advocate Sarode’s plea on November 28 last year. In the plea Sarode claimed that statutory panels like human rights commission were non-functional in the erstwhile state since the PM Modi-led BJP regime at the Centre junked the special status of Jammu and Kashmir and abrogated Article 370 in August 2019.

The Centre also bifurcated the former state in two Union Territories— Jammu and Kashmir and Ladakh—by introducing and passing the Jammu and Kashmir Reorganisation Bill in the Rajya Sabha on August 5, 2019. The Lok Sabha cleared the bill the next day.

The bench had asked Sarode to provide a copy of his petition to the law officer.

In his petition, Sarode has made the DoPT (Department of Personnel and Training), National Human Rights Commission, and the Law Commission of India parties to the PIL.

Bhartiya Janta Party MP Maneka Gandhi made controversial remarks against the International Society for Krishna Consciousness (ISKCON) temple. Maneka Gandhi said ISKCON is the biggest cheat in the country, it sells cows from its cowsheds to butchers.

After her scathing attack on the religious body, the temple authority refuted all the allegations made by the BJP MP and issued a letter stating unsubstantiated and false claims.

The national spokesperson of the ISKCON temple Yudhistir Govinda Das took to X, formerly Twitter and said response to the unsubstantiated and false statements of Maneka Gandhi.

Bank holidays in October 2023: Banks will remain closed for 18 days, check details

In October 2023, banks in various states of the country will witness 18 days of holidays, including Sundays and second and fourth Saturdays. It is to be noted that bank holidays will vary from state to state. The Reserve Bank of India regulates the functions of banks and decides their schedules and holidays for the entire year. 

As per the Reserve Bank of India guidelines, both public sector banks and private sector banks do not work on Sundays and on the second and fourth Saturdays of each month. The banks also remain closed on public holidays, including regional holidays which are decided by the state governments. 

In the month of October, banks across the country will remain closed on national holidays like Gandhi Jayanti on October 2. Reportedly, on October 24, a maximum number of banks will also remain non-functional because of the Dussehra holiday. Bank customers are advised to plan the bank-related works accordingly to avoid any last minute hassle. According to reports, internet banking services and ATMs will remain operational throughout the country on all days.

The first female auto driver from Delhi was attacked with stones and bricks by another auto-rickshaw driver in the Mehrauli area. The incident took place on September 24.

The victim Sunita Chaudhary, a resident of Malviya Nagar was chased and attacked. She suffered injuries on her face and leg in the shocking incident.

Sunita Chaudhary filed a complaint with the police, as per the complaint the conflict erupted when her auto had a minor collision with another driver’s auto. After a minor crash, the argument escalated with another auto driver and the assailant attacked her with stones.  

Sunita tried to contact PCR at least 50 times but there was no response. She also contacted the police but nobody came for help, as per the reports.

When she picked up a passenger from Munirka to the Mehrauli bus stand, Chaudhary said that another auto-rickshaw carrying its own passenger scraped her vehicle. The incident happened in a crowded lane and resulted in damage to the left side of Chaudhary’s autorickshaw, she said.

After dropping off a passenger at the Mehrauli bus stand, she noticed another autorickshaw parked nearby. Being curious about the earlier rash driving by its driver, she approached him and asked for an explanation. Unfortunately, he became very angry and started hitting and kicking Chaudhary’s parked auto, causing even more damage. She has alleged this incident as an act of aggression.

While driving an auto, Chaudhary narrowly avoided being hit by a man driving an auto. Despite the presence of several bystanders, no one came to her aid as the man started throwing bricks and stones at her. Chaudhary has been working as an auto driver in the city for twenty years. The Mehrauli police station has registered a case against the man under sections 427, 341, 323, and 279 of the Indian Penal Code for causing damage, wrongful restraint, causing hurt, and reckless driving on a public road.
