The Delhi High Court was informed on Monday that an Indian woman, Shahzadi Khan, who was on death row in Abu Dhabi for the alleged murder of a four-month-old child, had already been executed on February 15. The disclosure came during a hearing on a petition filed by her father, Shabbir Khan, seeking clarity about her well-being.

Justice Sachin Datta termed the development “very unfortunate” after Additional Solicitor General Chetan Sharma informed the court, “It is over. She was executed on February 15. Her last rites will be held on March 5.”

Shabbir Khan, a resident of Banda in Uttar Pradesh, had approached the court citing “profound uncertainty” about his daughter’s situation. Despite repeated applications to the Ministry of External Affairs (MEA), he had received no updates on her status.

Shahzadi Khan, 33, was handed over to Abu Dhabi police on February 10, 2023, and sentenced to death on July 31, 2023, following allegations that she murdered her employer’s infant child. She was lodged in Al Wathba jail until her execution.

The petition alleged that Shahzadi was inadequately represented in the local courts and was pressured into confessing to the crime, which led to her death sentence. Her father’s counsel stated during the hearing that their primary concern was to ascertain whether she was still alive or had been executed.

The counsel revealed that Shahzadi had called her family on February 14, informing them that she would be executed within a day or two and that it would be her last call. Since then, the family had been left in the dark about her condition.

The Centre’s counsel informed the court that Indian Embassy officials had been in touch with the family and were making arrangements for them to attend Shahzadi’s last rites in Abu Dhabi. “We did our best. We hired a law firm there to represent her in court. But the laws there deal with the murder of an infant very severely,” the counsel submitted.

According to the petition, Shahzadi traveled to Abu Dhabi in December 2021 on a legal visa. In August 2022, her employer gave birth to a son, and Shahzadi was employed as his caregiver. On December 7, 2022, the infant received routine vaccinations and tragically passed away that evening.

The petition claimed that the infant’s parents refused consent for a post-mortem and signed an agreement to waive further investigation into the death. Despite this, Shahzadi was arrested, tried, and sentenced to death.

Shabbir Khan’s plea highlighted the emotional toll on the family, stating, “On February 14, 2025, the petitioner’s daughter telephoned him from detention, informing him that she had been relocated within the facility and that, prior to her potential execution, her final wish was to speak with her parents.”

Sources suggest that central observers, including senior BJP leaders, are expected to arrive shortly to oversee the selection of the legislature party leader. The newly elected MLAs will then decide on the next Chief Minister.

Despite the formal resignation, party sources indicate that Sarma is likely to continue in the role for another term, given the BJP’s strong mandate in the state.

The move marks the beginning of the government formation process in Assam following the election results declared earlier this week.
