2019 Jamia Nagar violence: Delhi HC partially overturns discharge order of Sharjeel Imam, others; orders framing of fresh charges
The Delhi High Court on Tuesday ordered framing or fresh charges against jailed student leader Sharjeel Imam and ten other accused in the 2019 Jamia Nagar violence case as it partially overturned a trial court order discharging all the accused in the case.
The Delhi High Court on Tuesday ordered framing or fresh charges against jailed student leader Sharjeel Imam and ten other accused in the 2019 Jamia Nagar violence case as it partially overturned a trial court order discharging all the accused in the case.
The top court stated that Sharjeel and other accused were part of “unlawful assembly” that raised jumped police barricades and raised slogans against the Delhi Police.
It observed that while the right to freedom of expression cannot be denied, the right to peaceful assembly is subject to restrictions and damage to property and peace is not protected under the right.
On February 4, a trial ordered the discharging of Sharjeel Imam, Asif Iqbal Tanha among 11 people. In its judgement, the court ruled that the accused were made scapegoats by the police while observing that dissent must not be stifled but encouraged.
However, it ordered that charges be framed against one of the accused Mohammad Ilyas.
The 11 people discharged in the case are Sharjeel Imam, Tanha, Zargar, Mohammad Qasim, Mahmood Anwar, Shahzar Raza Khan, Mohammad Abuzar, Mohammad Shoaib, Umair Ahmad, Bilal Nadeem and Chanda Yadav.

A few days later, the Delhi Police challenged the trial court’s order all the accused named by the police in the chargesheet of the 2019 Jamia Nagar violence case. The police in their plea had termed the trial court’s order as “perverse” and “unsustainable in law”.
Violent protests erupted as locals clashed with the police during the demonstrations against Citizenship (Amendment) Act (CAA) in Delhi’s Jamia Nagar area in December 2019.
The police registered a case and lodged an FIR in which Sharjeel Imam was accused of instigating the riots by delivering a provocative speech at the Jamia Milia University on December 13, 2019.
Imam, who is also an accused in the 2020 northeast Delhi riots, would continue to stay behind bars even if the order had not been reversed.

Bengaluru police arrest Tejasvi Surya on charge of inciting riots in the state
The complaint alleges that Tejasvi’s actions during a protest in Bengaluru, with regard to the recent assault of a shopkeeper, was aimed at inciting religious sentiments and fostering communal hatred. The protest in question started from an assault on a shopkeeper in Bengaluru’s Cubbonpet.
BJP MP Tejasvi Surya was arrested by Bengaluru Police on Tuesday on charge of inciting riots in the state. Karnataka Congress also filed a complaint against him to the State Chief Election Officer for the breach of Moral Code of Conduct.
According to reports the shopkeeper was targeted for playing Hanuman Chalisa during the azaan. An FIR registered on March 18 states that he was assaulted for playing loud music. While 3 individuals have been arrested in connection with the assault, the police are investigating Mukesh’s claims that he was targeted for playing the Hanuman Chalisa.
Tejasvi Surya said immediately Mukesh and the neighbouring shopkeepers tried to reach the nearest police station to register an FIR. Even after submitting a detailed written complaint, the local police did not register an FIR. It was only after the intervention of PC Mohan, himself and local BJP leaders that the FIR was registerted at a belated stage. Meanwhile, the Bengaluru Police said that during the Azaan time, when a shopkeeper played a song loudly near Siddana Layout, in Bengaluru, an altercation occurred between a group of people and the shopkeeper.
The complaint stated that these actions violated the directives of the Supreme Court and the Election Commission, which prohibits inciting communal, caste and religious sentiments during elections. They gave out calls for Hanuman Chalisa recitation and chanted religious slogans. The police had not given permission for the protest due to the prevailing Model Code of Conduct for elections.
