In a decision that has sparked intense political and legal debate, the Siddaramaiah-led Karnataka cabinet has cleared the withdrawal of 60 criminal cases across the state, going against the advice of key departments including the police, prosecution and law.

Cases linked to DK Shivakumar’s supporters

According to official records, 11 of the cleared cases are linked to Congress workers and supporters of Deputy Chief Minister DK Shivakumar. These cases date back to 2019, when Shivakumar was arrested by the Enforcement Directorate in a money laundering case. His supporters had clashed with police in Bengaluru and other districts during protests, leading to charges of rioting, arson, stone-pelting and even assault on policemen.

Cases tied to mob violence and political clashes

The cabinet has also approved the withdrawal of a 2019 case from Kalaburagi, in which a mob stormed a police station after cattle and a vehicle were seized. The incident, which involved rioting and property damage, had led to serious charges against the accused. The case is being dropped at the request of state minister Priyank Kharge.

Other cases being scrapped include those linked to farmer agitations and the 2018 Ramdurga Assembly election victory celebration that saw communal clashes and violation of prohibitory orders by supporters of a BJP leader.

Opposition from police and legal experts

Despite a strong recommendation from the cabinet sub-committee on August 4, multiple state departments opposed the move, arguing that such withdrawals went against public interest and undermined the law.

Activist and advocate Girish Bhardwaj has vowed to challenge the decision before the Karnataka High Court. He argued that the withdrawal amounts to “political appeasement,” recalling that the court had earlier warned against such actions.

“The state is moving for political appeasement by withdrawing these cases. Last time, the High Court had made it clear that such orders violate criminal jurisprudence. I will once again challenge this to ensure it is quashed,” Bhardwaj said.

The appeal challenges the order passed by an Additional Chief Judicial Magistrate on August 3, 2026, when Brij Bhushan and Tomar were acquitted in the case.

Wrestlers challenge court’s reasoning

In their appeal, the wrestlers have argued that the acquittal order is legally unsustainable and that the evidence was not assessed appropriately.

They have also alleged that the order relied on assumptions about how victims of sexual assault and harassment were expected to behave instead of assessing the evidence and circumstances of the complainants.

Brij Bhushan was acquitted in August

The Rouse Avenue court acquitted Brij Bhushan Sharan Singh on August 3 in the sexual harassment case involving women wrestlers. The court’s decision followed consideration of the evidence and statements presented during the proceedings.

The case had emerged after several women wrestlers accused the former WFI chief of sexual harassment. The allegations had led to a major protest by wrestlers in 2023.

The latest appeal means the acquittal is now being challenged before a higher court.
