Supreme Court says maintenance is not charity but right of married women

The bench of Justices BV Nagarathna and Augustine George Masih said that the Muslim Women (Protection of Rights on Divorce) Act 1986 would not prevail over the secular law.

The Supreme Court on Wednesday said that maintenance is not charity but the right of married women, while pronouncing a landmark verdict on a petition by Mohd Abdul Samad challenging Telangana High Court’s order to pay a monthly of Rs 10,000 allowances to his divorced wife, under Section 125 CrPC.

The bench of Justices BV Nagarathna and Augustine George Masih, dismissing a petition filed by the Samad, said that the Muslim Women (Protection of Rights on Divorce) Act 1986 would not prevail over the secular law.

The Apex Court further said that some husbands have not become conscious of the fact that the wife, who is a homemaker, is dependent on them emotionally and financially. The time has come when the Indian man must recognise a homemaker’s role and sacrifice, the top court added.

While dismissing the plea, Justice Nagarathna stated that Section 125 CrPC would be applicable to all women and not just married women.

The petitioner, Samad, filed an appeal in the top court after he was directed to pay maintenance of Rs 20,000 to his ex-wife by a family court in Telangana. Under Section 125 of CrPC, the woman had moved the family court stating that her husband Samad had given her triple talaq. Samad appealed to the Telangana High Court,  which after modifying the amount to Rs 10,000 directed the petitioner to pay 10,000 as interim maintenance.

In the famous Shah Bano case, 1985, the Supreme Court had ruled that Section 125 of CrPC applies to everyone, irrespective of their religion. This was, however, diluted by the Muslim Women (Protection of Rights on Divorce) Act, 1986, which was enacted by the then government to nullify the Supreme Court verdict in the Shah Bano case.

Notably, in September 2001, the Constitution bench of the Supreme Court had, in the case Danial Latifi & Another vs Union Of India, upheld the constitutional validity of the 1986 Act.
