Supreme Court allows ASI to conduct survey of Gyanvapi Mosque complex, says no excavation

The Supreme Court on Friday allowed the Archaeological Survey of India (ASI) to conduct a survey of the Gyanvapi Mosque complex.

The SC refused to put a stay on the Allahabad High Court verdict order permitting the ASI Survey of the Gyanvapi Mosque.

The ASI stated that the survey’s entirety would be completed without excavation or damage to the structure and utilizing non-invasive methodology, according to the apex court.

The CJI stated that the ASI’s report must be submitted to the trial court and then follow the district judge’s instructions.

The Varanasi Court granted the Archaeological Survey of India an additional four weeks to complete the scientific survey of the Gyanvapi mosque adjacent to the Kashi Vishwanath temple.

The apex court declined the request of the Gyanvapi mosque management committee to keep the survey report private until the court decides whether the Hindu plaintiffs’ lawsuit is valid or not.

The committee’s lawyer, Senior Advocate Huzefa Ahmadi, argued before the bench that the exercise by the Archaeological Survey of India (ASI) is digging into history, violating the Places of Worship Act and impinging upon fraternity and secularism.

The Anjuman Intezamia Masjid Committee (AIMC) which is responsible for managing the mosque yesterday brought a case to the Supreme Court regarding the ASI survey challenging the Allahabad High Court order.

The ASI resumed its scientific survey of the Gyanvapi premises to determine whether the 17th-century mosque was built over the remains of a pre-existing Hindu temple. The hearing took place amidst these developments.

Supreme Court upheld the decision of Varanasi District court and Allahabad HC and made a provision that the survey will be carried out without causing any damage to the structure, said Hindu side advocate Vishnu Shankar Jain on Supreme Court’s verdict to allow ASI survey at Varanasi’s Gyanvapi mosque complex.

The Supreme Court has dismissed the petition of the Muslim side and allowed the ASI survey at the Gyanvapi mosque complex. The court has also directed ASI to continue its survey without any excavation at the site, said advocate Barun Sinha on Supreme Court’s verdict to allow ASI survey at Varanasi’s Gyanvapi mosque complex.

India’s message was delivered by Petal Gehlot, who represented New Delhi in the response to Pakistan.

India’s response focused on Pakistan’s record and its approach towards terrorism. New Delhi made clear that terrorism cannot be separated from its consequences and that those responsible cannot expect such actions to go unanswered.

Four women wrestlers have approached a Delhi court challenging the acquittal of former Wrestling Federation of India (WFI) chief and BJP leader Brij Bhushan Sharan Singh in a sexual harassment case.

The wrestlers have also challenged the acquittal of co-accused Vinod Tomar. The matter is scheduled to be heard by a Special Judge at the Rouse Avenue Courts.

The appeal challenges the order passed by an Additional Chief Judicial Magistrate on August 3, 2026, when Brij Bhushan and Tomar were acquitted in the case.

Wrestlers challenge court’s reasoning

In their appeal, the wrestlers have argued that the acquittal order is legally unsustainable and that the evidence was not assessed appropriately.

They have also alleged that the order relied on assumptions about how victims of sexual assault and harassment were expected to behave instead of assessing the evidence and circumstances of the complainants.

Brij Bhushan was acquitted in August

The Rouse Avenue court acquitted Brij Bhushan Sharan Singh on August 3 in the sexual harassment case involving women wrestlers. The court’s decision followed consideration of the evidence and statements presented during the proceedings.

The case had emerged after several women wrestlers accused the former WFI chief of sexual harassment. The allegations had led to a major protest by wrestlers in 2023.

The latest appeal means the acquittal is now being challenged before a higher court.
