Supreme Court issues notice to Delhi Police on Bibhav Kumar bail plea in Swati Maliwal assault case

The Supreme Court on Thursday issued a notice to Delhi Police on a plea filed by Chief Minister Arvind Kejriwal’s aide, Bibhav Kumar, accused of assaulting Aam Aadmi Party Rajya Sabha MP Swati Maliwal, challenging the Delhi High Court’s order denying him bail. The matter is set for its next hearing on August 7.

The bench headed by Justice Surya Kant, which included Justices Dipankar Datta and Ujjal Bhuyan, expressed reservations about Kumar’s assertion that he would not influence witnesses once bail is granted. More significantly, the court commented on the seriousness of the allegations, mentioning they were unconvinced by the defense argument, “If this kind of person can’t influence, who can?” The court further inquired about Maliwal’s purpose in visiting Kejriwal’s house, questioning if it was a private or an official visit.

Singhvi opposed the apparent reliance of the court on the FIR and emphasised the need for a fair process. The Supreme Court clarified that their concern was with the legal process and not the political dynamics.

Presently in judicial custody until 16 July, Kumar faces serious charges including criminal intimidation, assault with the intent to disrobe a woman, and attempted culpable homicide. He is also charged with tampering with evidence and providing false information.

The delay in filing the complaint shows inconsistencies, as pointed out by senior advocate Abhishek Singhvi while representing Kumar in the hearing. He argued that although the incident was alleged to have occurred on May 13, the FIR was filed on May 16. Singhvi contended that while Maliwal visited the police station on the day of the incident, no FIR was lodged then, but days after, which created a dent in the narrative.

Bibhav Kumar has denied all allegations, and the AAP has accused the BJP of setting a trap against their senior leader. The BJP is seeking Kejriwal’s resignation, alleging his involvement in shielding Kumar. The case has escalated into a major political controversy, with both parties trading accusations against each other.

The decision on the bail plea by the Supreme Court will now become crucial in light of the ongoing political and legal battle surrounding the case.

The resignation comes after the NDA’s strong electoral performance, where the alliance won a clear majority in the 126-member Assembly, ensuring its return to power for another term.

Despite the formal resignation, party sources indicate that Sarma is likely to continue in the role for another term, given the BJP’s strong mandate in the state.

The move marks the beginning of the government formation process in Assam following the election results declared earlier this week.
