Supreme Court says cinema hall can regulate movie goers from carrying food, beverages from outside
The Apex Court also observed that the Jammu and Kashmir High Court exceeded jurisdiction in passing such an order.
The Supreme Court led by Chief Justice of India DY Chandrachud directed that an owner of a cinema hall is entitled to regulate movie goers from carrying food and beverage from outside. The direction was passed by the bench consisting of CJI DY Chandrachud, Justice PS Narsimha.
The Apex Court in their judgement highlighted that a cinema hall owner has the right to regulate the entry of food and beverage. The Court also said that whether to consume what is available is entirely upon the choice of the movie goers.
The Court also observed that viewers go to the cinema halls for entertainment.
The Court also said that the viewers who enter the movie halls have to follow the rules set by the cinema hall owner and highlighted that it is evidently a matter of commercial decision of theatre owners.
The Apex Court passed the direction while hearing a batch of appeals filed by theatre owners and Multiplex Association of India challenging a 2018 verdict passed by Jammu and Kashmir High Court. The Supreme Court’s direction set aside the high Court’s order which allowed outside food in cinema halls after noting that the rules framed by Jammu and Kashmir did not prohibit movie goers from carrying their own food or water bottle inside the hall.
The Apex Court also observed that the High Court exceeded jurisdiction in passing such an order. The Court also said that it has been submitted to movie hall owners that drinking water to be supplied free of charge and also noted the scenario of when an infant accompanies a parent, as a matter of practice hall owners can’t object to reasonable amount of food for infant.
Senior Advocate KV Viswanathan contended the Jammu and Kashmir High Court Judgment as the legal aid cited that cinema halls are not a public property and added that admissions to such halls are reserved by hall owners. He further highlighted that there is no compulsion to buy the food.
The original petitioner had also submitted that the tickets bought by the movie goers represent a contract and added that in such case a movie goer can’t be prohibited from getting eatables inside the hall, however, the Apex Court while considering the petitioners submissions cited that the fundamental issue before the court was of trade and business of cinema halls.
The Court also said that the rules framed by the government did not prohibit bringing food into the cinema halls, however, the Supreme Court added that cinema hall owners have the right to carry on his trade and occupation by laying down terms and conditions.
The court also observed and said that the rule making power of the state has to be in alignment with the fundamental right of the hall owner in order to carry a business trade.

Punjab: Farmer’s rail roko protest enters 3rd day, disrupts train services

In Punjab and Haryana, the protest has halted hundreds of rail passengers.

The Swaminathan Commission report’s proposals for MSP and a 50,000 crore flood relief package for the states of northern India are what the farmers are asking for.
In addition, they want the debt of all farmers and labourers to be forgiven, as well as compensation of Rs 10 lakh and a government job for the families of each farmer killed during the protests against the three farm laws that have since been repealed.

Sankalp Saptaah: PM Modi today launches week-long initiative for aspirational blocks at Bharat Mandapam
The country’s Sankalp Saptah programme, which is being implemented in 500 aspirational blocks throughout 329 districts, seeks to increase block-level government while also improving civilian quality of life.
At Bharat Mandapam in New Delhi on Saturday, Prime Minister Narendra Modi introduced a week-long project named Sankalp Saptaah for the country’s aspirational groups.

The week-long programme, which is described in an official news release, is closely correlated with the national Aspirational Blocks Programme (ABP), which Modi introduced in January of this year.

He asserted that the quality of living had changed. Now, the aspirational blocks programme will be built on the success of the aspirational districts programme, he said.
According to the statement, about 3,000 panchayat and block level functionaries and representatives of the people are expected to attend the inaugural event at Bharat Mandapam, in addition to about two lakh farmers, block and panchayat level functionaries, and people from other walks of life who will participate virtually.
Starting on October 3 and running through October 9, each day of Sankalp Saptaah is devoted to a distinct development subject on which all aspirational blocks will focus. Sampoorna Swasthya, Suposhit Pariwaar, Swachhta, Krishi, Shiksha, and Samridhi Diwas are some of the themes for the first six days, according to the statement.
