The Supreme Court today delivered a split verdict on Hijab (headscarf) ban in the educational institutions in the country. One Judge upheld the Karnataka High Court verdict on this matter, while another Judge set aside this verdict and said that the entire concept of religious practice was not essential to the dispute.

In the light of divergence of opinion, the matter was placed before the Chief Justice of India for appropriate directions.

Justice Hemant Gupta dismissed the 26 appeals which were filed against the Karnataka High Court order which held that hijab was not an essential practice of Islam and allowed the Karnataka government to ban wearing the hijab in educational institutions.

Dismissing the appeals, he said that on the question of whether the government order served the purpose of access to education, the answer according to him was against the appellant.

However, Justice Sudhanshu Dhulia set aside the Karnataka High Court Judgment and said that the High Court took the wrong path. It was ultimately a matter of choice and Article 19 (1) (a) and 25 (1). It was a matter of choice and nothing more and nothing less.

He said that the main thrust of his judgement was that the entire concept of essential religious practice (ERP) was not essential to the dispute.

Justice Dhulia further said that One thing which was topmost for him was the education of girl child. A girl child finishes the household work and chores before going to school. He held that a judgment should be for making the girl’s life better. He respectfully differed. The thing which was uppermost in his mind was the education of a girl child.

He said that it was common knowledge that a girl child primarily in rural and semi-rural areas has a lot of difficulties. They have to do daily chores before she went to school. There were other difficulties as well.
