Supreme Court rejects anti-voter claim in Bihar voter list row, calls document rules voter friendly

The Supreme Court today rejected the contention that the Election Commission’s (EC) document verification process for the Special Intensive Revision (SIR) of Bihar’s voter lists was anti voter or exclusionary.

A bench comprising Justice Surya Kant and Justice Joymalya Bagchi was hearing petitions challenging the SIR exercise. Senior Advocate Abhishek Manu Singhvi, appearing for the petitioners, argued that the requirement to furnish certain documents effectively excluded many eligible voters.

Justice Bagchi observed that while seven types of documents were accepted as proof during the summary revision of electoral rolls, the number had been increased to 11 for the Special Intensive Revision. He acknowledged the petitioner’s concerns regarding Aadhaar but maintained that the expanded list of documents was voter friendly rather than exclusionary, noting that it offered a wider range of options for proving citizenship.

Justice Kant concurred, stating that requiring all 11 documents would indeed be anti voter, but clarified that if any single document from the list was sufficient, the process could not be considered exclusionary.

Singhvi countered by arguing that, in practice, several of the listed documents were either impractical or inaccessible for many voters. He pointed out that without land ownership, options 5, 6, and 7 were automatically unavailable, while options 1 and 2 did not exist for a significant portion of the population. He further noted that residence certificates were often not issued and passports remained beyond the reach of most citizens. According to him, the seemingly extensive list was merely a house of cards, burdened with overlapping and impractical requirements that could ultimately result in voter exclusion.

Justice Kant urged against portraying Bihar in a negative light, noting that the state holds the highest representation in All India Services such as the IAS, IPS, and IFS. He remarked that such achievements would not be possible if the younger population were not motivated.

Singhvi maintained that the process effectively forced people to prove their citizenship, violating the Supreme Court’s 1995 Lal Babu judgment, which held that voters names could only be removed with sufficient evidence and after giving them an opportunity to be heard.

Officials confirmed that no casualties were reported in either incident. However, the back-to-back nature of the explosions caused panic in nearby areas and prompted authorities to place the state on high alert.

Political leaders reacted strongly, questioning the handling of security and pointing to possible lapses. They urged authorities to take preventive steps to avoid such incidents in the future.

Punjab, being a strategically important border state, remains sensitive to such developments. Investigations are currently underway to determine the cause of the explosions and whether there are any links between the two incidents.

Security has been tightened around key installations, with agencies assessing whether the blasts were isolated events or part of a broader threat.
