As the turmoil in the state continues, observers hark back to history, question its special status and seek an overthrow of existing constitutional laws to enable a solution
Kashmir, once known all over India as Paradise on earth, has today become an issue of grave concern for the nation. The populace has come out in droves to protest against the killing of Burhan Wani, Hizbul Mujahideen commander, by the government’s forces. Firing on the demonstrators has taken its own toll which has now touched 43. The turmoil in Kashmir has become part of the debates in Parliament. Ghulam Nabi Azad, leader of the Congress, said his party is backing the government but is against what the people of the state are facing. Union Home Minister Rajnath Singh has blamed Pakistan for the unrest in the state. But it behoves us all to enquire why the people have come out in such force to mourn a militant. Is the government not working for their welfare?
Mudda, a daily current affairs talk show on APN TV, discussed the Kashmir problem with prominent experts from defense and politics.
Sharing his views on the reasons behind the current situation in Kashmir, Major General (Retd) SP Sinha said, “We need to go back to history, when all this started. Time and again, Pakistan has changed its strategy. It came to fight in 1947 but was defeated. In 1965, following our defeat by China, it attacked us and again got crushed. The same happened in 1971. After that Pakistan changed its strategy and formed the Lashkar-e-Toiba, Hizbul Mujahideen and Jaish-e-Mohammed, and it also propped up Geelani and other such people in our country. The funding coming from the US, UN and other sources was transferred through the ISI.” He added, “The problem in Jammu and Kashmir is due to the vested interests of some people.”
Defence analyst Praful Bakshi said, “The problem is not with Pakistan, the politicians there are not supporting the boss. Our military commanders also have some weaknesses. When they want to participate, they are forced to back out. They are denied participation on the grounds that it might be against the country’s security and national interest.”
Prof. Bheem Singh, President, National Panthers Party, said, “We are part of India. But we are neglected. Till now no action has been taken by the government, no resolution has been passed in Parliament.”
The BJP spokesperson, Munna Singh Chauhan, said, “In the name of democracy, freedom of speech and expression, people can say anything. They call the Burhan Wani killing unfortunate, fake, saying it shouldn’t have happened. The jawans are fighting, shedding their blood, but those sitting in air-conditioned rooms only know how to criticize. Why did Nehru take the plebiscite issue to the UN?”
Onkar Nath Singh, Congress General Secretary, Uttar Pradesh, asked, “Why are the talented students, the young generation of Kashmir, who are able to give tough competition in any field, be it engineering or medical science, upset at the government? Why are they protesting, taking up militancy?”
At this, Sinha questioned the validity of Article 370 and said, “First, the CM was called the PM in the Kashmir Valley. Then they were given special status and on January 19, 1990, the Muslims in the state called on Hindus to leave.” Bakshi added, “This is the problem, they don’t listen to us and we also don’t want to say things.”
SC ruling on transfer of cases
In the second part of the talk show, the experts’ panel discussed the historic judgment by the Supreme Court saying it has the power to transfer civil and criminal cases, including matrimonial disputes, to any part of the country. In Jammu and Kashmir, the Code of Criminal Procedure is not applicable. The Ranbir Penal Code is applied instead.
Sinha said, “The Supreme Court is the highest legal authority. The court is exercising its own rights. This is a matter to ponder.” He further asked, “Why is there a separate court in the Valley, why are the laws there different? Kashmiris can live anywhere in the country, why can’t people from other parts of the country live in the Valley?”
Bakshi said, “The leaders of the country are the lawyers. Now the time has come, Article 370 and all the other problematic laws should be scrapped. The ruling government should do this.”
Onkar Nath Singh said, “There has been a demand for a separate constitution for Kashmir. But it has been proved that the Indian Constitution is applicable there as well.”
Chauhan said, “We took the issue of Kashmir outside the borders of India. Those who are saying that security forces are violent should tell me, when they are thrown into the Jhelum river then who is being violent? When stones are pelted at the security forces, who is being violent? I tell you, the Kashmir issue has nothing to do with Indian Muslims.”
PH Parekh, senior advocate of the Supreme Court, said, “The powers given to the Supreme Court are under Article 32 and Article 142, where the apex court has the power to pass orders necessary for ensuring complete justice. Here, the Supreme Court has used Article 142, the court has power to transfer a case anywhere in the country. But a High Court cannot, it has the power to transfer cases in its region only. The Supreme Court has mentioned Article 142 in its decision.” He further added, “It is not that the cases don’t come from the Valley, they come and are heard.”
Bakshi commented, “Now the Pandora’s box is opening and many things are coming out.” He added, “There should be a fact-finding body to solve all the issues which should be totally neutral and autonomous.”

The San Antonio Zoological Society has come up with an idea for people to name a cockroach or rat after their ex-boyfriend or girlfriend. The event is called Cry Me a Cockroach, which is organised every year on Valentine’s Day. The society took to their Twitter handle and said that if people donate, their ex will be fed to an animal. They will also receive certificates.
There are some zoos in Pennsylvania, like Lehigh Valley Zoo, where people are allowed to name a bug after their former boyfriend or girlfriend. After this, these bugs are fed to their animals. All of this is done for just $5 or Rs 374.
Lehigh Valley Zoo came up with this brilliantly vicious, yet harmful idea, and took to their official Twitter handle to advertise. They said that they get it that sometimes, love sucks. So instead of feeling down that their love may not last forever, people should put a twist on Valentine’s Day and name a bug after their ex. They mentioned that all people have to do is to make a $5 donation to name one of the feeder crickets, and they will feed them to their ambassador animals. The offer is open till February 14, 2022.
