Kerala court

Kerala’s Kozhikode Session Court has issued a controversial statement in a sexual harassment case of activist Civic Chandran. The court said that section 354 A of the Indian Panel Code could not be invoked when a woman was wearing a sexually provocative dress.

The court observed that the images submitted by the accused would demonstrate that the complainant herself exposed outfits which had some sexually suggestive ones, and in this case, section 354 A (sexual harassment) will not prima facie stand against the accused.

Judge S Krishnakumar said that there was no adequate proof that the woman’s honour and dignity had been damaged in order to file a complaint.

He said that even if there was physical contact, it is inconceivable to think that a 74-year-old man with physical limitations could forcibly put the de facto complainant in his lap.

The incident happened in February 2020 at Nandi Beach near Koyilani where the accused allegedly grabbed the complainant’s hands, pressed her breast and urged her to sit on his lap.

Reports said that the decision was taken after a high-level meeting over the accommodation of Rohingya refugees that came from Myanmar.

According to reports the chief secretary of Delhi chaired the meeting and was attended by senior officials of Delhi government, Delhi Police and Ministry of Home Affairs.

A senior official said that the refugees will now be shifted to New Delhi Municipal Council (NDMC) flats in Bakkarwala village of Outer Delhi.

He said that there was a total of 250 flats belonging to the EWS category where all 1,100 Rohingyas, currently residing in the Madanpur Khadar camp, will be accommodated.

Earlier, the BJP and the RSS have been opposing the asylum of Muslim Rohingyas in the country. They argued that it will create security problems in the country.

Senior RSS leader Indresh Kumar said that Rohingyas were not inhabitants of India. They belong to Bangladesh, so how can they be allowed to stay in India? Moreover, they have been involved in terrorist activities here.

He urged Islamic nations to provide shelter to Rohingya refugees in their countries.

BJP spokesperson G V L Narsimha Rao also raised concern and said the Centre was meeting all humanitarian obligations, but it could not turn a blind eye to the fact that a large number of illegal immigrants residing here were posing a challenge to the security of the country.

However, Union Home Ministry has clarified that Rohingya illegal foreigners will continue at the present location.
