Big relief to UP government from Supreme Court, stay on Allahabad High Court’s decision related to civic elections

The Apex court of India has given a big relief to the Yogi government. The Supreme Court on Wednesday stayed the order of Allahabad High Court, in which Uttar Pradesh government was directed to conduct urban local body elections without reservation for OBCs.

The Supreme Court said that the panel appointed by the UP government has to decide within three months the issues related to OBC reservation for local body elections in the state. The court also said that the Uttar Pradesh government would be free to delegate powers after the end of the term to ensure that the administration of the local bodies is not disrupted during this period.

The apex court further added that after the end of the term of the Uttar Pradesh local bodies, the administrators to whom their powers will be handed over, will not take major policy decisions. A bench of Chief Justice DY Chandrachud and Justice PS Narasimha took note of the submissions of Solicitor General Tushar Mehta, appearing for the state government. The bench directed that the commission will have to decide the issues related to OBC reservation for elections to local bodies by March 31.

Earlier, the Supreme Court had agreed to hear the petition of the Uttar Pradesh government in the matter of local body elections. The matter was fixed for hearing on January 4. In fact, the UP government had moved the Supreme Court against the High Court’s order canceling the notification of urban local body elections. The Allahabad High Court, in its order, had struck down the government’s draft notification on civic polls.

The state government, in its petition, had said that the High Court cannot set aside the December 5 draft notification, which provides for reservation of seats in urban body elections for Scheduled Castes, Scheduled Tribes and Other Backward Classes. The appeal, filed through advocate on record Ruchira Goyal, had contended that OBCs are a constitutionally protected class and the High Court erred in quashing the draft notification.

TMC chief alleges irregularities in electoral process as BJP secures decisive victory in West Bengal

Mamata Banerjee on Tuesday launched a sharp attack on the Election Commission of India, accusing it of playing “nasty games” during the recently concluded West Bengal Assembly elections.

Reacting to her party’s defeat, the Trinamool Congress (TMC) chief alleged that the electoral process was not conducted fairly and raised serious concerns over the role of authorities in the outcome.
