Rafale deal: Supreme Court postpones review petition hearing to May 10

[vc_row][vc_column][vc_column_text]The Supreme Court today (Monday, May 6) adjourned to May 10 the hearing of petitions seeking review of its December 14, 2018 verdict giving clean chit to Narendra Modi government.

The postponement of the hearing scheduled today came after the Court learnt that the hearing in the contempt case against Congress chief Rahul Gandhi – forattributing the ‘chowkidar chorhai’ remark to the top court – hadbeen segregated and posted for that date although the court had said both here to be heard together.

Chief Justice of India Ranjan Gogoi said on Monday that he was perplexed that the two matters were not listed together and carry different dates while they were ordered to be heard together.

The matter will be heard on the day before the top court’s summer recess.

The top court had on April 10 dismissed objections over the admissibility of leaked documents petitioners had cited for seeking a review of its judgement from December last year rejecting a plea for a court-monitored probe into the purchase of the 36 fighter jets.

Petitioners had challenged the verdict upholding India’s deal with France after two media houses — The Hindu and ANI — published ‘leaked’ documents related to the deal for 36 fighter aircraft.

The review petitions have been filed by former Union ministers Yashwant Sinha and Arun Shourie in the Rafale case claiming the December 18 verdict in the case contained errors and relied on the government’s incorrect claims in an unsigned note given in a sealed cover.AamAadmi Party leader Sanjay Singh and lawyer Vineet Dhanda, too, have filed two more review petitions.

The Narendra Modi government had vehemently opposed the inclusion of these documents, saying they are “incomplete internal file notings procured unauthorisedly and illegally”, and that “the petitioners are attempting to bring out internal processing of this Government to Government procurement and trying to present a selective and incomplete picture of the same”.

In its affidavit filed last Saturday, the Centre said any review in the case would tantamount to questioning the government’s sovereign decision-related to national security and defence.

The government said the claims made in the review petitions are “scandalous, false, baseless and bereft of any particular material”. The affidavit said the ruling had no apparent “error warranting its review”.

It said the Prime Minister’s Office monitoring the progress of the deal for 36 Rafale jets could not be “construed as interference or parallel negotiations”.

The Centre said media reports cannot form the basis for seeking review of the judgement since it is well settled law that courts do not take decision on the basis of media reports.

Referring to the April 10 order of the apex court, by which the Centre’s preliminary objection to placing reliance on leaked documents was rejected by the top court, the Centre’s reply said the order “would imply that any document marked secret obtained by whatever means and placed in public domain can be used without attracting any penal action”.

The contempt case against Rahul Gandhi has been filed by the Bharatiya Janata Party’s (BJP’s) Meenakshi Lekhi for incorrectly attributing the slogan to the preliminary verdict of the top court on admissibility of documents in the Rafale case. Lekhi had asked the court to initiate criminal contempt action against Gandhi for twisting the top court’s April 10 judgment to claim that the court declared Prime Minister Narendra Modi guilty of corrupt practices in purchase of the Rafale aircraft.

Gandhi had apologised for misquoting the Supreme Court at the previous hearing. The court, however, had asked him to give a written apology and was not convinced by Gandhi’s earlier affidavit.

The three-judge SC Bench, also comprising Justice KM Joseph and SK Kaul, insisted that the hearing of both cases – review petition and contempt case – willbe held together and adjourned the matter. May 10 is the last day before the Supreme Court breaks for summer recess.

During the brief hearing, advocate Prashant Bhushan told the bench that he would argue the review pleas as well as an application seeking production of certain documents.

He said the court should allow his co-petitioner and former Union minister Arun Shourie to argue a separate application seeking perjury action against unknown government servants for allegedly misleading the court during the Rafale case hearing earlier.[/vc_column_text][/vc_column][/vc_row]

Prime Minister Narendra Modi today addressed in Alladurg, Telangana’s Sangareddy district, on Tuesday. During the rally PM claimed that if Congress comes to power, they will bring out inheritance tax. Since the Lok Sabha voting date schedule was revealed, this is PM Modi’s second visit to the state.

During the rally, PM Modi slammed Congress and said, when the whole world was progressing, India was suffering from policy paralysis under Congress government. He also said black money collected through Double R tax in Telangana is going to Delhi. Congress government in Telangana did not fulfill promise of loan waiver even 100 days after coming to power, says PM Modi.

The PM continued saying that the Congress had planned to collect 55% as inheritance tax, if it comes to power.

PM Modi at Telangana rally also took a jibe at former Chief Minister led-BRS party and said first it was that party which looted Telangana and now it is Congress.

For the BJP, Telangana is a crucial southern state in terms of strategy, since the party wants to gain a sizable number of seats in order to move closer to its lofty goal of 370 Lok Sabha seats. Amit Shah, the home minister, had earlier stated that Telangana should win ten seats out of a total of 17.

Meanwhile, Amit Shah will launch his campaign on May 1 in an effort to increase support for Madhavi Latha, the BJP’s candidate in Hyderabad, who is running against the sitting member of the legislature, Asaduddin Owaisi of AIMIM.

The BJP won four seats in Telangana in the previous 2019 elections. All candidates fielded by the party were from their respective constituencies, with the exception of Soyam Bapurao (Adilabad).

Along with National General Secretary Bandi Sanjay Kumar (Karimnagar), Nizamabad MP D Arvind, and BJP Telangana leader and Union minister G Kishan Reddy, who is running from Secunderabad, they have already begun strong campaigns in their respective electoral division.

Karnataka MP Prajwal Revanna suspended from JDS over sex scandal

Prajwal Revanna, the grandson of former Prime Minister HD Deve Gowda, was suspended by the JD(S) on Tuesday due to claims of sexual assault. Former Chief Minister and head of the JD(S), HD Kumaraswamy, stated that the decision was made because the party opposed injustice against women.

Kumaraswamy claimed that the vulgar videos were leaked just five days before the Hassan constituency polls, implying a plot against the JD(S). The NDA’s candidate in Hassan, which had its second round of elections on April 26, was Prajwal Revanna.

Till today, the victims have not filed complaints with the authorities. Regarding this, the Chief Minister has received a letter from the State Women’s Commission. The Chief Minister then constituted a SIT, according to Prajwal Revanna’s uncle Kumaraswamy.

The former Chief Minister said, his (Prajwal Revanna) suspension is until the investigation is completed.

The JD(S) MP allegedly fled the country for Germany as the obscene video clips purportedly featuring Prajwal began to circulate in Hassan.

Revanna was seen in the video recordings purportedly abusing several women sexually.

Amidst the incident, the MP and his father, JD(S) MLA and former minister HD Revanna, were accused of sexual harassment by a woman who worked in Prajwal’s household. In response to the woman’s complaint, both of them has been named in a case.

The eldest son of JD(S) patriarch Deve Gowda, HD Revanna, claimed there was politics underlying the matter and said he was amenable to an inquiry into the claims of sexual assault. Revanna said that if the accusations were validated, he and his son were prepared to answer to the authorities.

The Congress has seized the opportunity to attack the BJP and JD(S), an ally. According to a Congress spokesperson Suprya Shrinate, the BJP leader Devaraj Gowda, wrote to the party leadership last year regarding pen drives and Revanna’s sexual misconduct.

Congress workers protested the issue on Tuesday in Bengaluru and other cities of Karnataka.

Meanwhile, the Karnataka police have been asked to provide a report on the matter to the National Commission for Women (NCW) within three days.

Amit Shah slams Congress over fake video, plays out actual video, says BJP supports reservation

Home Minister Amit Shah today launched a frontal assault on the Congress, after a deepfake video of him claiming that he will eliminate reservations went viral. A Congress worker, Reetam Singh, from Guwahati, Assam, was taken into custody yesterday on suspicion of creating and disseminating the Home Minister’s deepfake video.

The deepfake video allegedly showed Shah discussing the scrapping of all reservations, but in reality, he was discussing the removal of Telangana’s Muslim quota due to religious reasons. In Karnataka, the BJP had eliminated this kind of quota before losing the state to the Congress.

Shah played both of the videos during a press conference today to show what he truly said and what the manipulated content said he said.

After playing the video Shah said, it is unfair and unacceptable to impose quotas based on religious beliefs. In Karnataka, they have already gotten rid of it. He had said in the original video.

The Home Minister claimed that the fake video twisted it to say the BJP will scrap all reservations.

As a matter of fact, Shah had said that the BJP would not permit anyone to remove reservations for Scheduled Castes, Scheduled Tribes, and Other Backward Classes, referring to this as Modi’s guarantee.

Rahul Gandhi claims that the BJP will remove reservations if it wins 400 seats. While we enjoyed a complete majority for two terms, as I mentioned earlier, Narendra Modi is a proponent of reservations. Shah said, he want to emphasize that it is a Modi promise that the BJP will not eliminate reservations for SCs, STs, and OBCs, nor will it permit anyone to do so.

The BJP’s demand for abki baar 400 paar has been accused by opposition parties of being a ploy to gain 400 seats in the Lok Sabha in order to gain enough members in parliament to remove ST, SC, and OBC quotas.
