The Division Bench of Justice Amit Sharma and Justice Siddharth Mridul of the Delhi court has said that, social media influencers and public figures can be criticized for their action, opinions and judgment, but this should not be extended to their children and family members.

The Delhi High court judges also expressed their dislike for dragging Gaurav Taneja’s child in the subjected article written by Live Mint (a subsidiary of Hindustan Times) journalist Shepali Bhatt.

The court believes that it was a matter of concern if a journalist’s freedom extends to reaching into someone’s house and making offensive comments on their family. Moreover, calling someone as child abuser that too without any proof was offensive.

Justice Mridul said, “if you don’t like what people say or do, then please criticize them but don’t reach into their houses. Because according to us, that is offensive. And whether this extends to journalist freedom or not, we don’t know at this time. Hence, this has to be decided.”

For those who don’t know, journalist Shepali Bhatt had put out an article on Live Mint claiming that Gaurav Taneja’s daily vlogs are often called out for misogyny, child abuse and political propaganda. This was after the YouTuber has tweeted a picture of himself with his wife and daughter performing a housewarming ritual.

In the tweet, Gaurav Taneja had also claimed that the Hindu ritual performing Havan or ‘Agnihotra’ purifies the air and also removes the pollutants. However, this claim was disputed by tweeple on social media.

After winning the trial, the Youtuber had announced that The Delhi High Court has asked the website daily to take down all the offensive tweets and articles.

Later in the day Gaurav had to tweet and ask his fans and followers not to use unsavory and abusive language for the journalist.
