The tech giant, Apple, which until recently only catered to dealing with western forms of discrimination has made an inclusive effort to add and tackle more forms of discrimination into its conduct policy. The tech giant, Apple, has become the first tech company to out rightly call out and ban Caste-based discrimination in employee conduct policy.

The understanding of caste discrimination is properly acknowledged in the Indian region but for the US folks, it would have been an unknown subject. Hence, the tech company has taken up the burden of sensitizing and informing its employees of other descent about the issue to train them up to the company standards and make sure they align to the principles set by the company.

Reportedly the new employee conduct policy was instated two years ago but the story was covered only recently. The policy is an add-on to the preceding policy which condemned discrimination against race, religion, gender, age, and ancestry.

The change in policy came in light of an event that transpired back in June 2020 in California where a lower caste employee with the help of California’s employee regulator sued two of his seniors who come from higher castes for blocking his career.

Another such incident took place when Thenmozhi Soundararajan, a Dalit rights activist, was asked to present at a talk on caste but was canceled due to internal issues that had alleged her to be inadequate for the subject she was presenting for.

These incidents became a wake-up call for tech giants to re-evaluate their code of conduct in light of their diversified employees.

Other organizations have also followed suit and reformed their code of conduct in consideration of their diverse team. IBM is another name that has come forward with its newly added policies and training to curtail Caste-based discrimination.

Other big tech giants namely Amazon, Dell, Facebook owner Meta, Microsoft, and Google don’t out rightly name caste in their global policy.

Kerala court

Kerala’s Kozhikode Session Court has issued a controversial statement in a sexual harassment case of activist Civic Chandran. The court said that section 354 A of the Indian Panel Code could not be invoked when a woman was wearing a sexually provocative dress.

The court observed that the images submitted by the accused would demonstrate that the complainant herself exposed outfits which had some sexually suggestive ones, and in this case, section 354 A (sexual harassment) will not prima facie stand against the accused.

Judge S Krishnakumar said that there was no adequate proof that the woman’s honour and dignity had been damaged in order to file a complaint.

He said that even if there was physical contact, it is inconceivable to think that a 74-year-old man with physical limitations could forcibly put the de facto complainant in his lap.

The incident happened in February 2020 at Nandi Beach near Koyilani where the accused allegedly grabbed the complainant’s hands, pressed her breast and urged her to sit on his lap.
