Supreme Court upholds 10 pc EWS quota in 3:2 verdict

The Supreme Court upheld the validity of the 103rd Constitution Amendment on Monday, which grants a 10 percent reservation in admissions to educational institutions and government jobs.

The five-judge bench headed by Chief Justice of India Uday Umesh Lalit also comprised Justices Dinesh Maheshwari, S Ravindra Bhat, Bela M Trivedi, and JB Pardiwala. The judgement was upheld by a 3:2 majority. While Justice Maheshwari, Justice Trivedi, and Justice Pardiwala were in the majority view, Chief Justice Lalit and Justice Bhat were in the minority view.

While reading out the verdict, Justice Maheshwari said the 103rd Constitutional Amendment is valid and doesn’t violate the basic structure of the Constitution. Agreeing with Justice Trivedi’s ideology about the need to revisit the reservation policy, Justice Pardiwala said that reservations cannot go on indefinitely; they should have a time span. There is a need to reexamine the reservation policy, he continued.

In his dissenting statement, Justice Ravindra Bhat said that the court was sanctioning a discriminatory decision. The amendment engages in kinds of discrimination that are expressly forbidden by the constitution by excluding SC, ST, and OBC poor people from economically underprivileged sections, he continued. Chief Justice UU Lalit concurred with the view of Justice Bhat.

Who can avail EWS quota benefits?

  • Family’s gross annual income should be below Rs. 8 lakhs. This includes income from all sources such as agriculture, salary, business, etc. for the financial year.
  • Family should not own agricultural land of size 5 acres or more or a residential flat of area 1000 square feet or more.
  • Family should not own a residential plot (in notified municipalities) of area of 100 square yards or more, or a residential plot (other than in notified municipalities) of an area of 200 square yards or more.

The 103rd Constitution Amendment Bill was passed by Parliament in January 2019 soon after the BJP lost Madhya Pradesh, Rajasthan and Chhattisgarh in general elections, and was instantly challenged in the Supreme Court.

Asian Games 2023: Men’s 10m Air Rifle team breaks world record to win first gold medal for India

India’s Men’s 10m Air Rifle team has broken the World Record to win the first gold medal for India in the Asian Games 2023. The team consists of Aishwary Pratap Singh Tomar, Divyansh Singh Panwar, Rudrankksh Balasaheb Patil shattered the world record and clinched India’s first gold medal of the games.

In the individual qualification round the three of them shot a total of 1893.7 points. They broke the world record set by China earlier that year at the Baku World championship. South Korea finished in the second spot with 1890.1 points. China came in third with a total score of 1888.2.

Aishwary registered 631.6 points. Diyyansh scored 629.6 points for the team. Rudrankksh finished in the third spot in qualification 631.6 points for India. All the three shooters also qualified for the top eight in the 10m Air Rifle event. India finished at the top position winning a gold medal in the team event.

According to the Asian Games rules only two participants from each nation can qualify for the final. This is the main reason Aishwary and Rudrankksh went to the finals and Divyansh missed out. The first series saw a slip up from the Indian shooters with Divyansh and Rudrankksh reaching 104.8 points each, while Aishwary scored 104.1. But they quickly regained their position.

They improved their sores in the following series. By the sixth series the team had broken the world record. They scored a total of 1893.7 points. This victory is very important for India as it is India’s first gold medal at the Asian Games 2023. It has set the standard for India’s performance at the games.

India has wrapped up the first day with a total of five medals. India’s medal tally includes two bronze medals and three silver medals. The 10m air rifle team featuring Ramita Jindal, Meghuli Ghosh and Ashi Chouksey won India’s first medal at Hangzhou 2023, a silver medal in shooting.

Hardeep Nijjar killing row: Canada’s defence minister says ties with India important

Canada’s defence minister Bill Blair said that his country’s ties with India are important. HIs statement amidst a diplomatic standoff between both the countries. However, he also added that his country wants a thorough investigation into the allegation. 

The escalating tensions between both the countries began after Canadian Prime Minister Justin Trudeau asserted that his country’s security agencies were investigating a link between the Indian government and the killing of Hardeep Singh Nijjar. 

Defence Minister Bill Blair noted that they understand this can be, and has proven to be, a challenging issue with respect to their relationship with India. However, at the same time, they have the responsibility to make sure that they carry out a thorough investigation and get to the truth, he added.

The Defence Minister further mentioned that if the allegations are proven true, there is a very significant concern that Canada will have with respect to the violation of our sovereignty. On the other hand, India rejected the allegation as absurd and motivated. 

India’s Ministry of External Affairs remarked that Canada has shared no specific information regarding its charges, flagging politically condoned hate crimes and criminal violence in that country. Furthermore, the foreign ministry has advised its nationals in Canada and those contemplating travelling there to exercise utmost caution.

Canadian Prime Minister Justin Trudeau also claimed that such credible allegations were shared with India weeks ago. He added that they want to work constructively with India and hope that New Delhi engages with them so that they can get to the bottom of this very serious matter.

Meanwhile, US Secretary of State, Antony Blinken, said that Washington is deeply concerned about the allegations and that they want to see accountability in the case.

Khalistani terrorist, Hardeep Singh Nijjar, 45, was shot dead outside a gurdwara in Canada’s British Columbia in June. He was chief of the banned Khalistan Tiger Force and reportedly one of India’s most wanted terrorists.

Congress leader Rahul Gandhi expressed his confidence in his party’s ability to win the upcoming legislative elections in Telangana, Madhya Pradesh, Chhattisgarh, and Rajasthan on Sunday. The Wayanad MP asserted at an event in the nation’s capital that there is no way we are not going to win any of them.

They are really close and he thinks they will be able to win, he said. Rahul Gandhi said, right now, he would say we are probably winning Telangana, they are definitely winning Madhya Pradesh and Chhattisgarh, and Rajasthan. By the year’s conclusion, elections are scheduled for the aforementioned states, he said.

The Congress MP said that the BJP wins districts and doesn’t allow the opposition to create a narrative as an important lesson that the party learned in Karnataka, where it staged a comeback earlier this year with overwhelming majorities.

He further said, they battled in a way in Karnataka that stopped the BJP from controlling the narrative, contrary to what they did there.

Gandhi claimed that the party sought to stray from the Opposition’s call for a caste census by using the insults leveled by BJP MP Ramesh Bidhuri against Bahujan Samaj Party MP Danish Ali as a distraction in the Lok Sabha.

He continued, every time we bring a topic to the table, they use this type of nonsense to divert, and they have now learned how to deal with it. They know that a caste census is a fundamental thing that the people of India want, and they don’t want to have that discussion.

Gandhi claimed that one of the key elements in Telangana, MP, and Chhattisgarh was controlling the narrative, which contributed significantly to Congress’ victory in Karnataka.

He stated, what we did in Karnataka was we provided the state with a clear vision and then we controlled the narrative.

Rahul Gandhi referred to the One Nation, one-election debate as one of the side problems the BJP used as an excuse to sidetrack from the important issues.
