UN expert says Stan Swamy’s custodial death will remain a stain on India’s human rights record

UN expert said the custodial death of Father Stan Swamy, 84, who had arrested under the UAPA and in connection with the Elgar Parishad-Bhima Koregaon case in October 2020, died in a Mumbai hospital on July, will remain a stain on India’s human rights record.

The death of Father Stan Swamy will continue to cast a cloud on India’s human rights record, said UN human rights expert Mary Lawlor. Arrested under the UAPA and in connection with the Elgar Parishad-Bhima Koregaon case in October 2020, Father Swamy, 84, died in a Mumbai hospital on July while his advocate was arguing the Jesuit priest be released on bail.

Lawlor, the UN Special Rapporteur on human rights, said in her statement released on Thursday that defenders of human rights should not be put behind bars under the flimsiest of excuses. She demanded that all others arrested along with Father Swamy be released immediately as others who have been put behind bars without sufficient legal basis.

India has rejected international criticism over the handling of Stan Swamy’s case and has highlighted its commitment to human rights, their promotion and protection. In a terse statement in the face of international condemnation and widespread social media anger at the Modi government, the Ministry of External Affairs said Stan Swamy was arrested and detained by the National Investigation Agency on the back of the specific charges against him and that he had legal recourse and pointed out that the courts had been rejected by the courts, and that the government had nothing to do with it.

Father Stan was arrested on October 8, 2020 by the National Investigation Agency (NIA), which alleged that the priest had Maoist connections and was working for the Communist Party of India (Maoist). In his defence, Swamy said evidence against him was fabricated and that he never conspired to foment violence.

Stan Swamy, who had been suffering from Parkinson’s disease, had been in Taloja Central Jail since October 9, 2020, after his arrest from his Bagaicha residence in Namkum near Ranchi on October 8 by the NIA.

Lahore – Faisal Nadeem, alias Abu Qatal, the nephew of Lashkar-e-Taiba (LeT) chief Hafiz Saeed and a key planner behind deadly attacks on civilians in Jammu and Kashmir, was shot dead in Pakistan’s Punjab province. Qatal was killed on Saturday night in the Dina area of Jhelum district when unidentified gunmen opened fire on his vehicle.

Mastermind of attacks in Jammu and Kashmir

Qatal was a high-ranking commander of the Pakistan-based terror outfit Lashkar-e-Taiba and was instrumental in orchestrating attacks targeting civilians in the Jammu region. He was allegedly responsible for the January 1, 2023, Dangri village attack in Rajouri, which claimed the lives of seven people, including two minors. The attackers had left behind an IED, which killed two children the following morning.

He was also the key conspirator behind the June 9, 2024, attack on a bus carrying Hindu pilgrims in Reasi district, where nine people were killed and 41 others injured. The bus, en route to the Shiv Khori cave temple, came under terrorist gunfire before plunging into a gorge.

Killed in targeted attack

As per reports, Qatal was traveling with his security personnel in Dina, Jhelum district, when assailants launched a sudden attack, riddling the vehicle with bullets. Qatal and one of his guards died instantly, while another was critically injured. The assailants managed to flee, and no group has claimed responsibility for the attack so far.

NIA had charge-sheeted Qatal

The National Investigation Agency (NIA) had previously charge-sheeted Qatal in connection with attacks in Jammu and Kashmir. Along with him, the NIA had named three Pakistan-based LeT handlers – Saifullah and Mohammad Qasim – for directing terror operations across the border. Qatal, also known by aliases Ali, Habibullah, Nouman, and Mohammad Qasim, played a key role in recruiting and deploying terrorists targeting civilians, particularly in minority-dominated areas of Jammu and Kashmir. His elimination marks a significant blow to LeT’s operations in the region.
