Supreme Court dismisses plea challenging bail to Congress leader DK Shivakumar

Congress leader DK Shivakumar, who walked out of jail last month, won’t be going back in for now as the Supreme Court today dismissed a plea challenging the Delhi High Court order granting him bail in a money-laundering case.

A bench comprising Justices RF Nariman and S Ravindra Bhat rejected the request of Solicitor General Tushar Mehta, appearing for the Enforcement Directorate.

The top Karnataka leader was arrested by the Enforcement Directorate in September and sent to the Tihar Jail, where another Congress leader P Chidambaram is lodged in an alleged corruption case. The investigators had alleged that Shivakumar, a seven-time MLA in Karnataka, had not been paying taxes and made transactions worth crores of rupees.

His 23-year-old daughter was also questioned by the agency days after his arrest. She was asked how her net worth grew from around Rs 1 crore in 2013 to over Rs 100 crore in 2018, and whether the financial transactions between her and her father involved unaccounted money.

The Delhi High Court had on October 23 granted bail to Shivakumar, and asked him not to influence witnesses or leave the country without the court’s permission. When the probe agency expressed fear that he might tamper with the evidence, the judges said he cannot do that as documents relevant to the case are with the investigating agencies.

Then the ED approached the Supreme Court challenging the decision.

The Congress has alleged that the case against 57-year-old Shivakumar, which has its origins in raids conducted by the Income Tax department when he had hosted 44 party legislators from Gujarat at a resort to prevent them from being poached by the BJP ahead of a crucial Rajya Sabha election in 2017, was part of an elaborate exercise by the two investigating agencies to target him.  Several properties linked to the Congress leader were also raided in August 2017.
